                   A  BILL  FOR  AN  ACT

RELATING TO MOTOR VEHICLE INSURANCE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that promoting educational
 
 2 excellence need not be confined to efforts made within the public
 
 3 educational system.  Instead, promoting and encouraging the
 
 4 education of Hawaii's youth should involve a statewide effort,
 
 5 involving sectors of the community who are not ordinarily
 
 6 associated with educational reform.
 
 7      The purpose of this Act is to restore a motor vehicle
 
 8 insurer's authority to grant discounted motor vehicle insurance
 
 9 rates to high school students with good academic records.
 
10      SECTION 2.  Section 431:10C-207, Hawaii Revised Statutes, is
 
11 amended to read as follows:
 
12      "§431:10C-207  Discriminatory practices prohibited.  No
 
13 insurer shall base any standard or rating plan, in whole or in
 
14 part, directly or indirectly, upon a person's race, creed, ethnic
 
15 extraction, age, sex, length of driving experience, credit bureau
 
16 rating, marital status, or physical handicap[.]; provided that an
 
17 insurer may base a favorable standard or rating plan upon the
 
18 fact that persons are high school students with good academic
 
19 records."

 1      SECTION 3.  Statutory material to be repealed is bracketed.
 
 2 New statutory material is underscored.
 
 3      SECTION 4.  This Act shall take effect upon its approval.
