                   A  BILL  FOR  AN  ACT

RELATING TO RENEWABLE ENERGY RESOURCES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature recognizes the economic,
 
 2 environmental, and fuel diversity benefits of renewable energy
 
 3 resources and intends to establish a market for renewable energy
 
 4 in Hawaii using the State's significant renewable energy
 
 5 resources and to lower the cost to be realized if the existing
 
 6 and future renewable energy resources are used to the maximum
 
 7 extent possible.
 
 8      The legislature finds that one way to achieve the desired
 
 9 goal of maximizing the use of renewable energy sources of
 
10 electricity is to clarify the existing policy in section
 
11 269-27.2, Hawaii Revised Statutes, relating to utilization of
 
12 electricity generated from nonfossil fuels.
 
13      While the intent of public policy is clear, the legislature
 
14 finds that the public utilities that supply electricity to the
 
15 public do not always maximize the use of renewable energy sources
 
16 of electricity on their systems.
 
17      The purpose of this Act is to require the public utilities
 
18 to adhere to the intent of the public policy in section 269-27.2,
 
19 Hawaii Revised Statutes.

 1      SECTION 2.  Section 269-27.2, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (b) to read as follows:
 
 3      "(b)  The public utilities commission [may] shall direct
 
 4 public utilities that supply electricity to the public to arrange
 
 5 for the acquisition of, and to acquire electricity generated
 
 6 from, available nonfossil fuel sources [as is available from and
 
 7 which the producers of same are willing and able to make
 
 8 available to the public utilities, and to] when the use of
 
 9 nonfossil fuel sources do not result in a significant increase in
 
10 rates or compromise in energy reliability.  These public
 
11 utilities shall employ and dispatch the nonfossil fuel generated
 
12 electricity in a manner consistent with [the] its availability
 
13 [thereof] to maximize the reduction in consumption of fossil
 
14 fuels in the generation of electricity [to be provided to the
 
15 public]."
 
16      SECTION 3.  Statutory material to be repealed is bracketed.
 
17 New statutory material is underscored.
 
18      SECTION 4.  This Act shall take effect upon its approval.
