                   A  BILL  FOR  AN  ACT

RELATING TO HAWAIIAN TERMINOLOGY.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 206G-4, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§206G-4  Powers; generally.  In its role as the local
 
 4 redevelopment authority for the redevelopment of the Kalaeloa
 
 5 community development district, and except as otherwise limited
 
 6 by this chapter, the commission may:
 
 7      (1)  Sue and be sued;
 
 8      (2)  Have a seal and alter the same at pleasure;
 
 9      (3)  Make and execute contracts and all other instruments
 
10           necessary or convenient for the exercise of its powers
 
11           and functions under this chapter;
 
12      (4)  Make and alter bylaws for its organization and internal
 
13           management;
 
14      (5)  Make rules with respect to its projects, operations,
 
15           properties, and facilities, in conformance with chapter
 
16           91;
 
17      (6)  Through its executive director appoint officers,
 
18           agents, and employees, prescribe their duties and
 
19           qualifications, and fix their salaries, without regard

 1           to chapters 76 and 77;
 
 2      (7)  Acquire, reacquire, or contract to acquire or reacquire
 
 3           by grant, lease, or purchase real, personal, or mixed
 
 4           property or any interest therein; to own, hold, clear,
 
 5           improve, and rehabilitate, and to sell, assign,
 
 6           exchange, transfer, convey, lease, or otherwise dispose
 
 7           of or encumber the same;
 
 8      (8)  Acquire or reacquire by condemnation real, personal, or
 
 9           mixed property or any interest therein for public
 
10           facilities, including but not limited to streets,
 
11           sidewalks, parks, schools, utility systems, and other
 
12           public improvements;
 
13      (9)  By itself, or in partnership with qualified persons,
 
14           acquire, reacquire, construct, reconstruct,
 
15           rehabilitate, improve, alter, or repair or provide for
 
16           the construction, reconstruction, improvement,
 
17           alteration, or repair of any project; own, hold, sell,
 
18           assign, transfer, convey, exchange, lease, or otherwise
 
19           dispose of or encumber any project, and in the case of
 
20           the sale of any project, accept a purchase money
 
21           mortgage in connection therewith; and repurchase or
 
22           otherwise acquire any project which the commission has
 
23           theretofore sold or otherwise conveyed, transferred, or

 1           disposed of;
 
 2     (10)  Arrange or contract for the planning, replanning,
 
 3           naming, renaming, opening, grading, or closing of
 
 4           streets, roads, roadways, alleys, or other places, or
 
 5           for the furnishing of facilities or for the acquisition
 
 6           of property or property rights or for the furnishing of
 
 7           property or services in connection with a project;
 
 8     (11)  Grant options to purchase any project or to renew any
 
 9           lease entered into by it in connection with any of its
 
10           projects, on such terms and conditions as it deems
 
11           advisable;
 
12     (12)  Prepare or cause to be prepared plans, specifications,
 
13           designs, and estimates of costs for the construction,
 
14           reconstruction, rehabilitation, improvement,
 
15           alteration, or repair of any project, and from time to
 
16           time to modify such plans, specifications, designs, or
 
17           estimates;
 
18     (13)  Provide advisory, consultative, training, and
 
19           educational services, technical assistance, and advice
 
20           to any person, partnership, or corporation, either
 
21           public or private, in order to carry out the purposes
 
22           of this chapter, and engage the services of consultants
 
23           on a contractual basis for rendering professional and

 1           technical assistance and advice;
 
 2     (14)  Contract for and accept gifts, grants, utility systems,
 
 3           roadway systems, or other improvements in any form from
 
 4           any public agency or from any other source;
 
 5     (15)  Arrange for or provide interim services, including but
 
 6           not limited to utilities, roadway maintenance and
 
 7           repair, security, and other services to the owners of
 
 8           properties being conveyed by the Navy under the base
 
 9           realignment and closure action; and recoup the costs
 
10           for these services including maintenance and
 
11           administrative costs from the owners of the properties
 
12           in proportion to their use of the services or benefits
 
13           therefrom; and
 
14     (16)  Do any and all things necessary to carry out its
 
15           purposes and exercise the powers given and granted in
 
16           this chapter."
 
17      SECTION 2.  Section 206G-7, Hawaii Revised Statutes, is
 
18 amended to read as follows:
 
19      "[[]§206G-7[]]  Kalaeloa community development district;
 
20 development guidance policies.  The following shall be the
 
21 development guidance policies generally governing the
 
22 commission's actions in the Kalaeloa community development
 
23 district:

 1      (1)  Development shall be in accordance with the community
 
 2           reuse plan;
 
 3      (2)  With the approval of the governor and concurrence of
 
 4           the Navy, the commission, upon the concurrence of a
 
 5           majority of its voting members, may modify and make
 
 6           changes to the reuse plan to respond to changing
 
 7           conditions; provided that prior to amending the reuse
 
 8           plan, the commission shall conduct a public hearing to
 
 9           inform the public of the proposed changes and receive
 
10           public input;
 
11      (3)  Development shall seek to promote economic development
 
12           and employment opportunities by fostering diverse land
 
13           uses and encouraging private sector investments which
 
14           utilize the opportunities presented by the receipt of
 
15           property from the base closure consistent with the
 
16           needs of the public;
 
17      (4)  The commission may engage in planning, design, and
 
18           construction activities inside the district and outside
 
19           the district; provided that activities outside the
 
20           district relate to infrastructure development, area-
 
21           wide drainage improvements, roadways realignments and
 
22           improvements, business and industrial relocation, and
 
23           other activities deemed by it necessary to carry out

 1           the redevelopment of the district and to implement this
 
 2           chapter.  Studies or coordinating activities to be
 
 3           undertaken by the commission may address facility
 
 4           systems, industrial relocation, and other activities in
 
 5           conjunction with the county and appropriate state
 
 6           agencies;
 
 7      (5)  Planning, replanning, rehabilitation, development,
 
 8           redevelopment and other preparation for reuse of
 
 9           Barbers Point Naval Air Station under this chapter are
 
10           public uses and purposes for which public money may be
 
11           spent and private property acquired;
 
12      (6)  Historic sites and culturally significant facilities,
 
13           settings, [and/or] and locations shall be preserved to
 
14           the extent feasible[;] and traditional Hawaiian names,
 
15           terms, and phrases restored;
 
16      (7)  Land use and redevelopment activities within the
 
17           district shall be coordinated with and to the extent
 
18           possible complement existing county and state policies,
 
19           plans, and programs affecting the district; and
 
20      (8)  Public facilities within the district shall be planned,
 
21           located, and developed to support the redevelopment
 
22           policies established by this chapter for the district,
 
23           the reuse plan approved by the governor, and rules

 1           adopted pursuant hereto."
 
 2      SECTION 3.  Statutory material to be repealed is bracketed.
 
 3 New statutory material is underscored.
 
 4      SECTION 4.  This Act shall take effect upon its approval.
