                   A  BILL  FOR  AN  ACT

PROPOSING AN AMENDMENT TO ARTICLE XII, SECTION 6, OF THE HAWAII
   CONSTITUTION RELATING TO THE BOARD OF TRUSTEES OF THE OFFICE
   OF HAWAIIAN AFFAIRS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Article XII, section 6, of the Constitution of
 
 2 the State of Hawaii is amended to read as follows:
 
 3                   "POWERS OF BOARD OF TRUSTEES
 
 4      Section 6.  The board of trustees of the Office of Hawaiian
 
 5 Affairs shall exercise power as provided by law[:  to manage and
 
 6 administer the proceeds from the sale or other disposition of the
 
 7 lands, natural resources, minerals and income derived from
 
 8 whatever sources for native Hawaiians and Hawaiians, including
 
 9 all income and proceeds from that pro rata portion of the trust
 
10 referred to in section 4 of this article for native Hawaiians;]
 
11 to formulate policy relating to affairs of native Hawaiians and
 
12 Hawaiians[; and to exercise control over real and personal
 
13 property set aside by state, federal or private sources and
 
14 transferred to the board for native Hawaiians and Hawaiians].
 
15 The board shall have the power to exercise control over the
 
16 Office of Hawaiian Affairs through its executive officer, the
 
17 administrator of the Office of Hawaiian Affairs, who shall be
 
18 appointed by the board.  The board shall transfer all assets and

 1 resources, other than federal grants and private donations, to
 
 2 the Hawaiian Homes Commission."
 
 3      SECTION 2.  The question to be printed on the ballot shall
 
 4 be as follows:
 
 5      "Shall all the assets and resources of the office of
 
 6 Hawaiian affairs, other than federal grants and private
 
 7 donations, be transferred to the Hawaiian Homes Commission?"
 
 8      SECTION 3.  Constitutional material to be repealed is
 
 9 bracketed.  New constitutional material is underscored.
 
10      SECTION 4.  This Act shall take effect upon ratification of
 
11 a constitutional amendment requiring the transfer of all assets
 
12 and revenues from the office of Hawaiian affairs to the Hawaiian
 
13 Homes Commission.
