                   A  BILL  FOR  AN  ACT

RELATING TO ADMINISTRATIVE REVOCATION OF DRIVER'S LICENSE.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 286-261, Hawaii Revised Statutes, is
 
 2 amended by amending subsections (b) and (c) to read as follows:
 
 3      "(b)  The periods of administrative revocation that [may]
 
 4 shall be imposed under this part are as follows:
 
 5      (1)  Three months, if the arrestee's driving record shows no
 
 6           prior alcohol enforcement contacts during the five
 
 7           years preceding the date of arrest;
 
 8      (2)  [One year] Two years if the arrestee's driving record
 
 9           shows one prior alcohol enforcement contact during the
 
10           five years preceding the date of arrest;
 
11      (3)  [Two] Four years if the arrestee's driving record shows
 
12           two prior alcohol enforcement contacts during the seven
 
13           years preceding the date of arrest;
 
14      (4)  For life if the arrestee's driving record shows three
 
15           or more prior alcohol enforcement contacts during the
 
16           ten years preceding the date of arrest; or
 
17      (5)  For arrestees under the age of eighteen years, the
 
18           period remaining until the arrestee's eighteenth
 
19           birthday, or for the appropriate revocation period

 1           provided in paragraphs (1) to (4) or in subsection (c),
 
 2           whichever is longer.
 
 3      (c)  The license of an arrestee who refuses to be tested
 
 4 after being informed of the sanctions of this part shall be
 
 5 revoked under subsection (b)(1), (2), and (3) for a period of one
 
 6 year, [two] four years, and [four] eight years, respectively."
 
 7      SECTION 2.  This Act does not affect rights and duties that
 
 8 matured, penalties that were incurred, and proceedings that were
 
 9 begun, before its effective date.
 
10      SECTION 3.  Statutory material to be repealed is bracketed.
 
11 New statutory material is underscored.
 
12      SECTION 4.  This Act shall take effect upon its approval.
