                   A  BILL  FOR  AN  ACT

RELATING TO QUARANTINE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 150A-6, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (b) to read as follows:
 
 3      "(b)  The board shall maintain:
 
 4      (1)  A list of conditionally approved animals that require a
 
 5           permit for import into the State;
 
 6      (2)  A list of restricted animals that require a permit for
 
 7           both import into the State and possession; and
 
 8      (3)  A list of animals that are prohibited entry into the
 
 9           State;
 
10 provided that the board shall adopt rules, pursuant to chapter
 
11 91, to establish an ad hoc panel of no fewer than three members
 
12 with applicable expertise in vertebrate biology to identify
 
13 whether an animal is a prohibited hybrid animal when the
 
14 department suspects that the lineage of the animal is not as
 
15 stated by the owner or on other official documents.
 
16      Animals on the lists of conditionally approved and
 
17 restricted animals shall be imported only by permit[.]; provided
 
18 that a permit shall be issued within three working days upon
 
19 receipt of an application permit for the following animals:
 
20 ladybird beetle (chilorcus circumdatus, chilorcus baileyii,

 1 lindorus lophante, rhyzobius lophante, crytolaemus montrouziera,
 
 2 and coleomegilla maculata), praying mantid (tenodera aridifolia
 
 3 sinensis), mealybug parasite (leptomastix dactylopii), fly
 
 4 parasite (nasonia vitripennis and muscidifurax zaraptor), green
 
 5 lacewing (chysoperla rufilabris), six spotted thrips (scolothrips
 
 6 sexmaculatus), aphid parasite (aphidius colemani), aphid predator
 
 7 (aphidoletes aphidomyza), big eyed bug (geocoris punctipes),
 
 8 beneficial nematode (heterohabditis megidis and steinernema
 
 9 feltiae), moth egg parasite (trichogramma minutum, trichogramma
 
10 pretiosum, and trichogramma platneri), white fly parasite
 
11 (encarsia formosa and eretmocerus nr. californicus), white fly
 
12 predator (delphastus pusillus), thrips predator (neoseiulus
 
13 cucumeris), minute pirate bug (orius insidiosus), black scale
 
14 parasite (metaphycus belvolus), red scale parasite (aphytus
 
15 melinus), purple scale parasite (aphytus lepidosaphes), leafminer
 
16 parasite (diglyphus isaea), predatory mite (phytoseiulus
 
17 persimilis, mesoseuilus longpipes, neoseiulus californicus,
 
18 galendromus occidentalis, and hypoaspis miles).
 
19      Any animal that is not on the lists of conditionally
 
20 approved, restricted, or prohibited animals shall be prohibited
 
21 until the board's review and determination for placement on one
 
22 of these lists; provided that the department may issue a special
 
23 permit on a case-by-case basis for the importation and possession

 1 of an animal that is not on the lists of prohibited, restricted,
 
 2 or conditionally approved animals, for the purpose of remediating
 
 3 medical emergencies or agricultural or ecological disasters, or
 
 4 conducting medical or scientific research in a manner that the
 
 5 animal will not be detrimental to agriculture, the environment,
 
 6 or humans if the importer of the animal can meet permit
 
 7 requirements as determined by the board; and provided further
 
 8 that the department may issue a short-term special permit on a
 
 9 case-by-case basis not to exceed ninety days for the importation
 
10 and possession of an animal that is not on the list of
 
11 prohibited, restricted, or conditionally approved animals for the
 
12 purpose of filming, performance, or exhibition if the importer of
 
13 the animal can meet permit and bonding requirements as determined
 
14 by the board."
 
15      SECTION 2.  Statutory material to be repealed is bracketed.
 
16 New statutory material is underscored.
 
17      SECTION 3.  This Act shall take effect upon its approval.
