REPORT TITLE:
Special License Plates


DESCRIPTION:
Clarifies that the minimum membership requirement for
organizations seeking special number license plates applies to
nonprofit organizations and veterans groups and not to government

                   A  BILL  FOR  AN  ACT

RELATING TO MOTOR VEHICLES. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 249-9.3, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (b) to read as follows:
 
 3      "(b)  For the purposes of this section, the following terms
 
 4 shall have the following meanings:
 
 5      "Director" unless indicated otherwise by its context, means
 
 6 the county directors of finance.
 
 7      "Organization" means [an]:
 
 8      (1)  An organization of at least one hundred members in good
 
 9           standing that is:
 
10     [(1)] (A)  A not-for-profit organization recognized as such
 
11                by the Internal Revenue Service and whose primary
 
12                purpose is to provide the community with specific
 
13                programs to improve the public's health,
 
14                education, or general welfare; or 
 
15     [(2)] (B)  A military service veterans group; [or 
 
16      (3)] (2)  A state or county agency approved by the
 
17                director[.
 
18      Any organization includes any]; or
 
19      (3)  Any school or accredited institution of higher learning

 1           or a college or recognized program thereof.
 
 2      "Special number plate" means a license plate with a decal on
 
 3 its face that represents an organization as defined in this
 
 4 section."
 
 5      SECTION 2.  Section 249-9.3, Hawaii Revised Statutes, is
 
 6 amended by amending subsection (d) to read as follows:
 
 7      "(d)  An organization shall apply for a special number plate
 
 8 with the director on an application form prescribed by the
 
 9 director.  The application shall include:
 
10      (1)  A design of the organization's decal;
 
11      (2)  A signed notarized statement by an officer or director
 
12           of the organization that the organization will acquire
 
13           at least one hundred fifty special number plates; and
 
14      (3)  The dollar amount the organization plans to raise from
 
15           each special number plate.
 
16      The director shall determine, based on criteria in this
 
17 section, and the director's discretion, whether an organization's
 
18 application has been accepted or rejected.  The director shall
 
19 also seek the approval of an organization's decal design from the
 
20 county chief of police where the application is made.
 
21      If the director rejects an application, the director shall
 
22 state the reasons for the rejection in writing and shall allow
 
23 the applicant to reapply within a reasonable period after the

 1 rejection.
 
 2      After an organization's application has been approved,
 
 3 [members of the organization] a motor vehicle owner may apply for
 
 4 the organization's special number plate.  The director may
 
 5 require proof of membership of an organization's members or the
 
 6 organization's approval in addition to the completion of a form
 
 7 as prescribed by the director.  Special number plates shall be
 
 8 issued only to the registered owner of an applicant motor
 
 9 vehicle." 
 
10      SECTION 3.  Statutory material to be repealed is bracketed.
 
11 New statutory material is underscored.
 
12      SECTION 4.  This Act shall take effect upon its approval.
