                   A  BILL  FOR  AN  ACT

RELATING TO PRINCIPALS AND VICE PRINCIPALS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 89-6, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (a) to read as follows:
 
 3      "(a)  All employees throughout the State within any of the
 
 4 following categories shall constitute an appropriate bargaining
 
 5 unit:
 
 6      (1)  Nonsupervisory employees in blue-collar positions;
 
 7      (2)  Supervisory employees in blue-collar positions;
 
 8      (3)  Nonsupervisory employees in white-collar positions;
 
 9      (4)  Supervisory employees in white-collar positions;
 
10      (5)  Teachers and other personnel of the department of
 
11           education under the same salary schedule, including
 
12           part-time employees working less than twenty hours a
 
13           week who are equal to one-half of a full-time
 
14           equivalent;
 
15      (6)  Educational officers and other personnel of the
 
16           department of education under the same salary
 
17           schedule[;], except for principals and vice-principals;
 
18      (7)  Faculty of the University of Hawaii and the community
 
19           college system;

 1      (8)  Personnel of the University of Hawaii and the community
 
 2           college system, other than faculty;
 
 3      (9)  Registered professional nurses;
 
 4     (10)  Institutional, health, and correctional workers;
 
 5     (11)  Firefighters;
 
 6     (12)  Police officers; and
 
 7     (13)  Professional and scientific employees, other than 
 
 8 registered professional nurses.
 
 9      Because of the nature of work involved and the essentiality
 
10 of certain occupations that require specialized training, units
 
11 (9) through (13) are designated as optional appropriate
 
12 bargaining units.  Employees in any of these optional units may
 
13 vote either for separate units or for inclusion in their
 
14 respective units (1) through (4).  If a majority of the employees
 
15 in any optional unit desire to constitute a separate appropriate
 
16 bargaining unit, supervisory employees may be included in the
 
17 unit by mutual agreement among supervisory and nonsupervisory
 
18 employees within the unit; if supervisory employees are excluded,
 
19 the appropriate bargaining unit for these supervisory employees
 
20 shall be (2) or (4), as the case may be.
 
21      The compensation plans for blue-collar positions pursuant to
 
22 section 77-5 and for white-collar positions pursuant to section
 
23 77-13, the salary schedules for teachers pursuant to section

 1 302A-624 and for educational officers pursuant to section
 
 2 302A-625, and the appointment and classification of faculty
 
 3 pursuant to sections 304-11 and 304-13, existing on July 1, 1970,
 
 4 shall be the bases for differentiating blue-collar from white-
 
 5 collar employees, professional from institutional, health and
 
 6 correctional workers, supervisory from nonsupervisory employees,
 
 7 teachers from educational officers, and faculty from nonfaculty.
 
 8 In differentiating supervisory from nonsupervisory employees,
 
 9 class titles alone shall not be the basis for determination, but,
 
10 in addition, the nature of the work, including whether or not a
 
11 major portion of the working time of a supervisory employee is
 
12 spent as part of a crew or team with nonsupervisory employees,
 
13 shall also be considered."
 
14      SECTION 2.  Section 302A-625, Hawaii Revised Statutes, is
 
15 amended to read as follows:
 
16      "[[]§302A-625[]]  Educational officers' salary schedules.
 
17 (a)  The salary schedule for all educational officers of the
 
18 department, except for principals and vice-principals, shall be
 
19 negotiated pursuant to section 89-9.
 
20      (b)  The salary schedule for all principals and vice
 
21 principals shall be determined by the board of education and
 
22 shall be set at a higher level than the salary schedule that was
 
23 in effect for fiscal year 1999-2000.

 1     [(b)] (c) Any principal, vice-principal, or other educational
 
 2 officer on a ten-month work year must earn at least six credits
 
 3 within a three-year cycle [in order] to receive an increment or
 
 4 longevity step increase in the third year of the three-year
 
 5 cycle." 
 
 6     SECTION 3.  Statutory material to be repealed is bracketed.
 
 7 New statutory material is underscored.
 
 8     SECTION 4.  This Act shall take effect upon its approval.
