                   A  BILL  FOR  AN  ACT

RELATING TO IDENTITY THEFT.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 708, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§708-    Unauthorized use of another person's information
 
 5 to obtain credit, goods, money, services, or anything of value.
 
 6 (1)  A person commits the offense of unauthorized use of another
 
 7 person's information to obtain credit, goods, money, services, or
 
 8 anything of value if the person makes or causes to be made,
 
 9 either directly or indirectly, any false statement with the
 
10 unauthorized use of another person's information in writing, by
 
11 voice, or by electronic transmission, knowing it to be false with
 
12 the intent that it be relied on, in respect to the person's
 
13 identity or that of any other person, for the purpose of
 
14 obtaining credit, goods, money, services, or anything of value.
 
15      (2)  Unauthorized use of another person's information to
 
16 obtain credit, goods, money, services, or anything of value is a
 
17 misdemeanor.
 
18      (3)  Unauthorized use of another person's information to
 
19 obtain credit, goods, money, services, or anything of value is a

 1 class C felony if the value of the money, goods, or services
 
 2 obtained or attempted to be obtained exceeds $300 in any six-
 
 3 month period.
 
 4      (4)  "Person's information" means an individual's name,
 
 5 address, telephone number, electronic mail address, driver's
 
 6 license number, social security number, employment or place of
 
 7 employment, employee identification number, mother's maiden name,
 
 8 identifying number of a depository account, and any other name,
 
 9 number or code that is used, along or in conjunction with other
 
10 such information, to confirm the identity of a specific person."
 
11      SECTION 2.  This Act does not affect rights and duties that
 
12 matured, penalties that were incurred, and proceedings that were
 
13 begun, before its effective date.
 
14      SECTION 3.  New statutory material is underscored.
 
15      SECTION 4.  This Act shall take effect upon its approval.
