                   A  BILL  FOR  AN  ACT

RELATING TO COURT REPORTERS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 606, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§606-    Private court reporters; gifts or incentives.  (a)
 
 5 No private court reporter shall engage in conduct that is likely
 
 6 to undermine the private court reporter's impartiality, that is
 
 7 improper, or gives the appearance of impropriety.
 
 8      (b)  No private court reporter or entity providing the
 
 9 services of a private court reporter may offer any gift,
 
10 incentive, prize, or award, including but not limited to cash,
 
11 trips, gift certificates, stuffed animals, movie tickets, or
 
12 airline tickets or coupons to any client, attorney, a party to a
 
13 legal action, or a party having a financial interest in a legal
 
14 action, or an employee thereof.
 
15      (c)  Fines for the violation of this section shall be:
 
16      (1)  $500 for the first offense;
 
17      (2)  $1,000 for the second offense; and
 
18      (3)  Not less than $1,500 and not more than $2,000 for any
 
19           subsequent offense."
