                     A BILL FOR AN ACT

RELATING TO AGRICULTURAL LANDS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Notwithstanding chapter 171, Hawaii Revised
 
 2 Statutes, or any other provision to the contrary, the management
 
 3 of any state lands classified as intensive agricultural use,
 
 4 special livestock use, pasture use, or commercial timber use
 
 5 under section 171-10, Hawaii Revised Statutes, shall be
 
 6 transferred from the department of land and natural resources to
 
 7 the department of agriculture.
 
 8      SECTION 2.  The department of land and natural resources,
 
 9 with the cooperation of the department of agriculture, shall
 
10 develop an action plan detailing what needs to be done for the
 
11 transfer of land management provided for in section 1.  The
 
12 action plan shall include:
 
13      (1)  Identification of lands to be transferred;
 
14      (2)  Identification of contracts, deeds, agreements,
 
15           permits, and other documents involved in the transfer;
 
16      (3)  Identification of personnel and what their roles will
 
17           be in facilitating the transfer;
 
18      (4)  Breakdown of funding needed to effectuate the transfer;
 
19           and

 1      (5)  Proposed draft legislation, if needed, to facilitate
 
 2           the transfer. 
 
 3      The department of land and natural resources shall submit
 
 4 its action plan to the legislature no later than twenty days
 
 5 before the convening of the regular session of 2001.
 
 6      SECTION 3.  This Act shall take effect on July 1, 2000,
 
 7 except that section 1 shall take effect on July 1, 2003.
