                   A  BILL  FOR  AN  ACT

RELATING TO HANDGUNS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 134, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§134-      Proof of insurance.  (a ) Each person who owns a
 
 5 handgun shall maintain liability insurance for an amount not less
 
 6 than $1,000,000.  Liability insurance required under this section
 
 7 shall apply only to bodily injury or death resulting from the
 
 8 negligent discharge of a handgun.
 
 9      (b)  No person may acquire a handgun from any source without
 
10 demonstrating proof of insurance in accordance with article
 
11 431:   -   ."
 
12      SECTION 2.  The Hawaii Revised Statutes is amended by adding
 
13 three new sections to chapter 431 to be appropriately designated
 
14 and to read as follows:
 
15      §431:  -   Definitions.  As used in this part, unless the
 
16 context requires otherwise:
 
17      "Handgun insurance" is insuring against bodily injury,
 
18 disablement, or death by accident, or accidental means, or the
 
19 expense thereof, against disablement or expense resulting from

 1 the negligent discharge of a handgun and every insurance
 
 2 appertaining thereto.
 
 3      "Handgun" means a pistol, revolver, or other firearm of any
 
 4 description, loaded or unloaded, from which any shot, bullet, or
 
 5 other missile can be discharged and the length of the barrel, not
 
 6 including any revolving, detachable, or magazine breech, does not
 
 7 exceed twelve inches.
 
 8      §431:  - Scope. (a)  All handgun insurance shall be
 
 9 subject to the provisions of this article.  Handgun insurance
 
10 delivered or issued for delivery in this State shall be primary
 
11 to all other forms of insurance which may cover bodily injury or
 
12 death resulting from the negligent discharge of a firearm.
 
13      (b)  Coverage under this section shall be in an amount of no
 
14 less than $1,000,000.
 
15      §431:  -   Premiums and premium reductions.(a)  Any
 
16 insurer may revise its schedules of premiums rates from time to
 
17 time, and shall file the revised schedules for approval with the
 
18 commissioner.
 
19      (b)  Persons who show proof that firearms in their
 
20 possession are properly stored in a vault or safe specifically
 
21 designed for the storage of firearms shall receive a        per
 
22 cent reduction in their premiums.

 1      (c)         per cent of the premiums collected in this State
 
 2 for handgun liability insurance shall be paid on an annual basis
 
 3 to the State general fund and shall be used for the costs of
 
 4 administering the commissioner's obligations under this article."
 
 5      SECTION 3.  New statutory material is underscored.
 
 6      SECTION 4.  This Act shall take effect upon its approval.
