                   A  BILL  FOR  AN  ACT
RELATING TO VEHICLES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 249-2, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§249-2 Imposition of tax[.]; penalty.  (a)  Except as
 
 4 otherwise provided in sections 249-1 to 249-13, and except in the
 
 5 case of antique motor vehicles which shall be subject to an
 
 6 annual tax of $10 in lieu of the annual tax otherwise imposed by
 
 7 this section, all vehicles and motor vehicles as defined in
 
 8 section 249-1, shall be subject to an annual tax, computed,
 
 9 except for the minimum tax provided for in section 249-13
 
10 according to the net weight of each vehicle at a rate determined
 
11 as [hereinafter] provided in section 249-13.  The tax shall
 
12 become due and payable on January 1, and must be paid before
 
13 April 1[, in] of each year.  The tax shall be paid by the owner
 
14 of each vehicle in the county in which the vehicle is located at
 
15 the time of registration, whether the original registration or
 
16 any subsequent registration, and shall be collected by the
 
17 director of finance of [such] that county; provided that if any
 
18 [such] vehicle is transported to another county after the payment
 
19 of [such] this tax, no additional tax shall be imposed on [such]
 
20 the vehicle for the remaining period of the year for which [such]

 1 the tax has been paid."
 
 2      (b)  Any person who uses a motor vehicle upon a public
 
 3 highway of this State, the tax upon which is delinquent, shall be
 
 4 fined not more than $500."
 
 5      SECTION 2.  Section 249-11, Hawaii Revised Statutes, is
 
 6 amended to read as follows:
 
 7      "§249-11  Fraudulent use of plates, tags, or emblems [and
 
 8 other misdemeanors]; penalties.  Any person who manufactures,
 
 9 sells, or distributes vehicle number plates, tags, or emblems of
 
10 a design and size similar to the currently issued series of
 
11 number plates, tags, or emblems authorized by the director of
 
12 finance, or who attaches to and uses on any vehicle plates, tags,
 
13 or emblems not furnished in accordance with sections 249-1 to
 
14 249-13 or 286-53, or who fraudulently uses [such] number plates,
 
15 tags, or emblems upon any vehicle other than the one for which
 
16 the number plates, tags, or emblems were issued, or who molests
 
17 or disturbs any vehicle which has been seized pursuant to
 
18 sections 249-1 to 249-13, [or any person who knowingly uses a
 
19 motor vehicle, the tax upon which is delinquent, upon public
 
20 highways of this State,] or any director of finance who issues a
 
21 certificate of registration or number plates, tags, or emblems to
 
22 any person who has not paid the tax required by sections 249-1 to
 
23 249-13, or any person who violates any of the provisions of

 1 [such] sections, shall be fined not more than $500."
 
 2      SECTION 3.  Statutory material to be repealed is bracketed.
 
 3 New statutory material is underscored.
 
 4      SECTION 4.  This Act shall take effect on July 1, 2000.
