RELATING TO THE JUDICIARY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  This Act shall be known and may be cited as the
 
 2 Judiciary Supplemental Appropriations Act of 2000.
 
 3      SECTION 2.  This Act amends Act 156, Session Laws of Hawaii
 
 4 1999.
 
 5      SECTION 3.  Part II, Act 156, Session Laws of Hawaii 1999,
 
 6 is amended to read as follows:
 
 7                 "PART II.  PROGRAM APPROPRIATIONS
 
 8      SECTION 3.  The following sums, or so much thereof as may be
 
 9 sufficient to accomplish the purposes and programs designated
 
10 herein, are appropriated or authorized from the sources of
 
11 funding specified to the judiciary for the fiscal biennium
 
12 beginning July 1, 1999, and ending June 30, 2001.  The total
 
13 expenditures and the number of permanent positions established in
 
14 each fiscal year of the fiscal biennium shall not exceed the sums
 
15 and the position ceilings indicated for each year, except as

 8      SECTION 4.  Part III, Act 156, Session Laws of Hawaii 1999,
 
 9 is amended:
 
10      1.  By adding three new sections to be appropriately
 
11 designated and to read as follows:
 
12      "SECTION 8.1.  Provided that of the general fund
 
13 appropriation for administrative services (JUD 201), not more
 
14 than $400,000 for fiscal year 2000-2001 shall be expended for on-
 
15 line personnel management; provided further that the judiciary
 
16 shall provide a report on implementation and cost-benefit
 
17 analysis to the legislature no later than twenty days prior to
 
18 the convening of the 2001 regular session.
 
19      SECTION 8.2.  Provided that of the general fund
 
20 appropriation for family court (JUD 112), not more than $222,690
 
21 for fiscal year 2000-2001 shall be expended to create two
 
22 additional circuit court clerk II positions, two additional court
 
23 bailiff II positions, one additional judicial clerk III position,
 
24 and one additional social worker IV position to assist with
 
25 domestic violence cases.

 1      SECTION 8.3.  Provided that of the general fund
 
 2 appropriation for family court (JUD 112), $250,000 for fiscal
 
 3 year 2000-2001 shall be expended for purchase of services related
 
 4 to domestic violence intervention."
 
 5      2.  By amending Section 6 to read as follows:
 
 6      "SECTION 6.  Provided that of the general fund appropriation
 
 7 for circuit courts (JUD 111), $50,000 for fiscal year 1999-2000
 
 8 shall be expended to establish and implement the alternatives to
 
 9 incarceration pilot program; provided further that an additional
 
10 $50,000 for fiscal year 2000-2001 shall be expended for the same
 
11 purposes."
 
12      SECTION 5.  Part IV, Act 156, Session Laws of Hawaii 1999,
 
13 is amended to read as follows:
 
14         "PART IV.  CAPITAL IMPROVEMENTS PROGRAM PROJECTS
 
15      SECTION 9.  The sum of [$33,870,000] $40,860,000
 
16 appropriated or authorized in part II of this Act for capital
 
17 improvement projects shall be expended by the judiciary for the
 
18 projects listed below; provided that several related or similar
 
19 projects may be combined into a single project if a combination
 
20 is advantageous or convenient for implementation; and provided
 
21 further that the total cost of the projects thus combined shall
 
22 not exceed the total of the sums specified for the projects
 
23 separately.  (The amount after each cost element and the total
 
24 funding for each project listed in this part are in thousands of
 
25 dollars.)

10      SECTION 6.  Part V, Act 156, Session Laws of Hawaii 1999, is
 
11 amended by amending section 10 to read as follows:
 
12                       "PART V.  ISSUANCE OF BONDS
 
13      SECTION 10.  General obligation bonds may be issued, as provided
 
14 by law, to yield the amount that may be necessary to finance projects
 
15 authorized in part II and listed in part IV of this Act; provided that
 
16 the sum total of the general obligation bonds so issued shall not
 
17 exceed [$33,870,000.] $40,860,000."
 
18      SECTION 7.  Part VI, Act 156, Session Laws of Hawaii 1999, is
 
19 amended by adding a new section to read as follows:
 
20      "SECTION 17.A  Provided that funding for Item No. 12 under Part
 
21 IV, Capital Improvement Projects Program shall not supplant any other

 1      SECTION 8.  Act 156, Session Laws of Hawaii 1999, is amended by
 
 2 adding a new section to read as follows:
 
 3      "SECTION 10A.  Any law to the contrary notwithstanding the
 
 4 appropriation under Act 155, Session Laws of Hawaii 1997, section 13,
 
 5 as amended and renumbered by Act 126, Session Laws of Hawaii 1998,
 
 6 section 5, in the amounts indicated or balances thereof, unallotted,
 
 7 unencumbered, and unrequired, are hereby lapsed:

10      SECTION 9.  If any portion of this Act or its application to
 
11 any person or circumstances is held to be invalid for any reason,
 
12 the remainder of the Act and any provision thereof shall not be
 
13 affected.  If any portion of a specific appropriation is held to
 
14 be invalid for any reason, the remaining portion shall be
 
15 independent of the invalid portion and shall be expended to
 
16 fulfill the objective and intent of the appropriation to the
 
17 extent possible.
 
18      SECTION 10.  If any manifest clerical, typographical, or
 
19 other mechanical error is found in this Act, the chief justice is
 
20 authorized to correct the error.  All changes made pursuant to
 
21 this section shall be reported to the legislature at its next

 1      SECTION 11.  Statutory material to be repealed is bracketed.

 3      SECTION 12.  This Act shall take effect on July 1, 2000.
