                   A  BILL  FOR  AN  ACT
RELATING TO ELECTIONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 11-115, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§11-115  Arrangement of names on the ballot.  The names of
 
 4 the candidates shall be placed upon the ballot for their
 
 5 respective offices in alphabetical order except as provided in
 
 6 section 11-118 and the limitations of the voting system in use,
 
 7 and except for the case of the candidates for vice president and
 
 8 lieutenant governor in the general election whose names shall be
 
 9 placed immediately below the name of the candidate for president
 
10 or governor of the same political party.
 
11      In elections using the paper ballot or electronic voting
 
12 systems where the names of the candidates are printed and the
 
13 voter records the voter's vote on the face of the ballot, the
 
14 following format shall be used:  A horizontal line shall be ruled
 
15 between each candidate's name and the next name, except between
 
16 the names of presidential and vice presidential candidates and
 
17 candidates for governor and lieutenant governor of the same
 
18 political party in the general election.  In such case the
 
19 horizontal line will follow the name of the candidates for vice
 
20 president and lieutenant governor of the same political party,

 1 thereby grouping the candidates for president and vice president
 
 2 and governor and lieutenant governor of the same political party
 
 3 within the same pair of horizontal lines.  Immediately [after all
 
 4 the names, on the right side of the ballot,] to the left of
 
 5 (before) or to the right of (after) the candidate name or names,
 
 6 according to the requirements of the voting system, two vertical
 
 7 lines shall be ruled, so that in conjunction with the horizontal
 
 8 lines, a box shall be formed [opposite each] to the left of or to
 
 9 the right of the name and its equivalent, if any.  In case of the
 
10 candidates for president and vice president and governor and
 
11 lieutenant governor of the same political party, only one box
 
12 shall be formed opposite their set of names.  The boxes shall be
 
13 of sufficient size to give ample room in which to designate the
 
14 choice of the voter in the manner prescribed for the voting
 
15 system in use.  All of the names upon a ballot shall be placed at
 
16 a uniform distance from the left edge and close thereto, and
 
17 shall be of uniform size and print subject to section 11-119."
 
18      SECTION 2.  Statutory material to be repealed is bracketed.
 
19 New statutory material is underscored.
 
20      SECTION 3.  This Act shall take effect upon its approval.
