                   A  BILL  FOR  AN  ACT

RELATING TO HUNTING LICENSES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 183D, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to part II to be appropriately
 
 3 designated and to read as follows:
 
 4      "§183D-    Applications and issuance of hunting licenses;
 
 
 6 refuse to renew, reinstate, or restore, or deny any license if
 
 7 the department has received certification from the child support
 
 8 enforcement agency pursuant to section 576D-13 that the licensee
 
 9 or applicant is not in compliance with an order of support or has
 
10 failed to comply with a subpoena or warrant relating to a
 
11 paternity or child support proceeding.  The department shall
 
12 issue, renew, restore, or reinstate such a license only upon
 
13 receipt of an authorization from the child support enforcement
 
14 agency, the office of child support hearings, or the family
 
15 court."
 
16      SECTION 2.  Section 183D-3, Hawaii Revised Statutes, is
 
17 amended to read as follows:
 
18      "§183D-3  Rules.  Subject to chapter 91, the department
 
19 shall adopt, amend, and repeal rules:

 1      (1)  Concerning the preservation, protection, regulation,
 
 2           extension, and utilization of, and conditions for entry
 
 3           into wildlife sanctuaries, game management areas, and
 
 4           public hunting areas designated by the department;
 
 5      (2)  Protecting, conserving, monitoring, propagating, and
 
 6           harvesting wildlife;
 
 7      (3)  Concerning size limits, bag limits, open and closed
 
 8           seasons, and specifications of hunting gear which may
 
 9           be used or possessed; [and]
 
10      (4)  Setting fees for activities permitted under this
 
11           chapter, unless otherwise provided by law[.]; and
 
12      (5)  To carry out other purposes of this chapter.
 
13 The rules may vary from county to county or in any part of the
 
14 county and may specify certain days of the week or certain hours
 
15 of the day in designating open seasons, except that any fees
 
16 established by rule shall be the same for each county.  All rules
 
17 shall have the force and effect of law."
 
18      SECTION 3.  Section 183D-22, Hawaii Revised Statutes, is
 
19 amended by amending subsections (a) and (b) to read as follows:
 
20      "(a)  A hunting license shall be issued to a person by an
 
21 agent of the department upon:
 
22      (1)  Written application in the form prescribed by the

 1           department;
 
 2      (2)  Payment of a hunting license fee or any other hunting
 
 3           related fee the board may require as provided in this
 
 4           chapter; except that payment of the fee shall be waived
 
 5           for any employee of the department who is required to
 
 6           have a license to carry out duties of the department;
 
 7           and
 
 8      (3)  Showing a valid Hawaii hunter education certificate or
 
 9           written exemption issued under section 183D-28 or upon
 
10           showing proof of completion of an approved hunter
 
11           education course described in section 183D-28(b)(2).
 
12 The application shall require a statement under oath of the
 
13 applicant's name, address, domicile or residence, length of
 
14 residence in the State, age, race, height, weight, and color of
 
15 hair and eyes[.], and if prohibited from using firearms.
 
16      (b)  The hunting license fee shall be:
 
17      (1)  [$10 for] For any person who has resided in the State
 
18           for one year or longer, or who is a member of the armed
 
19           forces of the United States on active duty and the
 
20           spouse and children thereof, or who elects to forgo the
 
21           exemption provided in paragraph (3)[;]:
 
22           (A)  $25 for a combination game bird and game mammal

 1                license;
 
 2           (B)  $15 for a game mammal license; and
 
 3           (C)  $15 for a game bird license;
 
 4      (2)  [$95 for] For all other persons[;]:
 
 5           (A)  $200 for a combination game bird and game mammal
 
 6                license;
 
 7           (B)  $150 for a game mammal license; and
 
 8           (C)  $100 for a game bird license; and
 
 9      (3)  Free to all Hawaii residents sixty-five years of age or
 
10           older and to all persons with Hansen's disease who are
 
11           residents of Kalaupapa, Molokai."
 
12      SECTION 4.  Section 183D-22, Hawaii Revised Statutes, is
 
13 repealed.
 
14      ["§183D-22  Application and issuance of licenses; fees.(a)
 
15 A hunting license shall be issued to a person by an agent of the
 
16 department upon:
 
17      (1)  Written application in the form prescribed by the
 
18           department;
 
19      (2)  Payment of a hunting license fee or any other hunting
 
20           related fee the board may require as provided in this

11      (b)  The hunting license fee shall be:

21      (c)  The department shall suspend, refuse to renew,
 
22 reinstate, or restore, or deny any license if the department has

 1 received certification from the child support enforcement agency
 
 2 pursuant to section 576D-13 that the licensee or applicant is not
 
 3 in compliance with an order of support or has failed to comply
 
 4 with a subpoena or warrant relating to a paternity or child
 
 5 support proceeding.  The department shall issue, renew, restore,
 
 6 or reinstate such a license only upon receipt of an authorization
 
 7 from the child support enforcement agency, the office of child
 
 8 support hearings, or the family court."]
 
 9      SECTION 5.  Statutory material to be repealed is bracketed.
 
10 New statutory material is underscored.
 
11      SECTION 6.  This Act shall take effect on July 1, 2000;
 
12 provided that sections 1 and 4 of this Act shall take effect upon
 
13 the adoption of administrative rules by the department of land
 
14 and natural resources pertaining to the application and issuance
 
15 of hunting licenses, including the establishment of hunting
 
16 license fees.
