                   A  BILL  FOR  AN  ACT

RELATING TO DISPOSITION OF WATER RIGHTS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 171-58, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (c) to read as follows:
 
 3      "(c)  Disposition of water rights may be made by lease by
 
 4 direct negotiation, by lease at public auction as provided in
 
 5 this chapter, or by permit [for temporary use] on a month-to-
 
 6 month basis under those conditions which will best serve the
 
 7 interests of the State and subject to a [maximum] term of one
 
 8 year and other restrictions under the law; provided that the
 
 9 board may allow a permit to continue on a month-to-month basis
 
10 for additional one-year periods; provided further that any
 
11 disposition by lease shall be subject to disapproval by the
 
12 legislature by two-thirds vote of either the senate or the house
 
13 of representatives or by majority vote of both in any regular or
 
14 special session next following the date of disposition; provided
 
15 further that after a certain land or water use has been
 
16 authorized by the board subsequent to public hearings and
 
17 conservation district use application and environmental impact
 
18 statement approvals, water used in nonpolluting ways, for
 
19 nonconsumptive purposes because it is returned to the same stream

 1 or other body of water from which it was drawn, essentially not
 
 2 affecting the volume and quality of water or biota in the stream
 
 3 or other body of water, may also be leased by the board with the
 
 4 prior approval of the governor and the prior authorization of the
 
 5 legislature by concurrent resolution."
 
 6      SECTION 2.  Statutory material to be repealed is bracketed.
 
 7 New statutory material is underscored.
 
 8      SECTION 3.  This Act shall take effect upon its approval.
