                   A  BILL  FOR  AN  ACT

RELATING TO THE HAWAII WORKFORCE DEVELOPMENT COUNCIL.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 202-1, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§202-1  Council; appointment; tenure.  The advisory
 
 4 commission on employment and human resources is hereby
 
 5 constituted as the workforce development council.  The council
 
 6 shall also fulfill the functions of the state workforce
 
 7 investment board for purposes of the federal Workforce Investment
 
 8 Act of 1998, Public Law No. 105-220.
 
 9      [The] Except for the ex officio members or their designees,
 
10 the council members shall be appointed for four-year staggered
 
11 terms as provided for in section 26-34.  The governor shall
 
12 appoint the chairperson of the council and the two mayors to the
 
13 council.  The council shall be composed of twenty-nine to thirty-
 
14 one members.  The members shall be selected on the basis of their
 
15 interest in and knowledge of workforce development programs in
 
16 the State and how they can support economic development.  The
 
17 council shall be composed of the following representatives of
 
18 which the majority shall be from the private sector:
 
19      (1)  The directors of labor and industrial relations, human

 1           services, and business, economic development, and
 
 2           tourism; the superintendent of education; and the
 
 3           president of the University of Hawaii[,] or their
 
 4           designees, as ex officio voting members;
 
 5      (2)  Fifteen to sixteen private sector representatives from
 
 6           business, including at least one member from each of
 
 7           the four county workforce development boards;
 
 8      (3)  One representative from a community-based native
 
 9           Hawaiian organization that operates workforce
 
10           development programs;
 
11      (4)  Two representatives from labor;
 
12      (5)  Four members of the legislature, two from each house,
 
13           appointed by the appropriate presiding officer of each
 
14           house[;], as ex officio voting members; [and]
 
15      (6)  Two mayors or their [representatives.] designees, as ex
 
16           officio voting members; and
 
17      (7)  The governor or the governor's designee.
 
18      The members shall serve without compensation but shall be
 
19 entitled to travel expenses when actually engaged in business
 
20 relating to the work of the council."
 
21      SECTION 2.  Statutory material to be repealed is bracketed.
 
22 New statutory material is underscored.
 
23      SECTION 3.  This Act shall take effect upon its approval.
