                   A  BILL  FOR  AN  ACT

RELATING TO WORKERS' COMPENSATION SPECIAL COMPENSATION FUND
   EXPENSES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 386-155, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]§386-155[]  Litigation expenses.] Expenses.  All
 
 4 litigation expenses, including but not limited to court costs,
 
 5 attorneys' fees, and witness fees incurred by the director in
 
 6 preparation, prosecution, or defense of any action brought on
 
 7 behalf of or against the special compensation fund shall be paid
 
 8 from the fund.  Administrative expenses for the protection and
 
 9 preservation of the special compensation fund shall also be paid
 
10 from the fund."
 
11      SECTION 2.  There is appropriated out of the special
 
12 compensation fund of the State of Hawaii the sum of $282,595, or
 
13 so much thereof as may be necessary for fiscal year 2000-2001, to
 
14 carry out the purpose of the special compensation fund, including
 
15 the hiring of six full-time equivalent permanent positions
 
16 subject to chapters 76 and 77 Hawaii Revised Statutes.  The sum
 
17 appropriated shall be expended by the department of labor and
 
18 industrial relations.

 1      SECTION 3.  Statutory material to be repealed is bracketed.
 
 2 New statutory material is underscored.
 
 3      SECTION 4.  This Act shall take effect upon its approval.
