                   A  BILL  FOR  AN  ACT

MAKING AN EMERGENCY APPROPRIATION FOR THE STATE'S MEDICAID HOME
   AND COMMUNITY BASED SERVICES FOR THE DEVELOPMENTALLY
   DISABLED OR MENTALLY RETARDED PROGRAM.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  This Act is recommended by the governor for
 
 2 immediate passage in accordance with section 9 of article VII of
 
 3 the Constitution of the State of Hawaii.
 
 4       SECTION 2.  The purpose of this Act is to appropriate and
 
 5 authorize additional funds for the State's Medicaid Home and
 
 6 Community Based Services for the Developmentally Disabled or
 
 7 Mentally Retarded program, also known as a Title XIX waiver
 
 8 program, within the Department of Health.  The additional funds
 
 9 will support current clients, provide for the admission of more
 
10 people to the program, and address issues raised by Makin v.
 
11 State of Hawaii, U.S. Dist. Ct., Civil No. 98-00997 DAE.
 
12      SECTION 3.  The following sums, or so much thereof as may be
 
13 necessary for fiscal year 1999-2000 for the purposes of this Act,
 
14 are appropriated, or authorized as the case may be, from money in
 
15 the treasury received from general revenues and federal funds,
 
16 unless otherwise specified.
 
17      (1)  There is appropriated out of the general revenues of
 
18 the State of Hawaii the sum of $367,268 or so much thereof as may

 1 be necessary for fiscal year 1999-2000, to the department of
 
 2 health for HTH 501 CN for the state share of funds for the
 
 3 Medicaid Home and Community Based Services-Developmental
 
 4 Disabilities/Mental Retardation program, in addition to the
 
 5 $10,960,669 appropriated for that purpose as part of the
 
 6 appropriation for HTH 501 by section 3, part II, item E-8 of Act
 
 7 91, Session Laws of Hawaii 1999, provided that no funds shall be
 
 8 made available under this Act unless the federal government
 
 9 provides match funding for 51.01 per cent of the program for
 
10 which this sum is appropriated.
 
11      (2)  For Department of Human Services for HMS 603, increase
 
12 the federal match funds for the state Medicaid Home and Community
 
13 Based Services-Developmentally Disabled/Mental Retardation
 
14 program by $2,115,755 for fiscal year 1999-2000, in addition to
 
15 the $10,836,549 authorized for that purpose as part of the
 
16 appropriation for HMS 603, section 3, part II, item F-25 by Act
 
17 91, Session Laws of Hawaii 1999.
 
18      (3)  For Department of Human Services for HMS 603, increase
 
19 the interdepartmental transfer funds for the state Medicaid Home
 
20 and Community Based Services-Developmental Disabilities/Mental
 
21 Retardation program by $491,388 for fiscal year 1999-2000, in
 
22 addition to the $10,836,549 authorized for that purpose as part

 1 of the appropriation for HMS 603, section 3, part II, item F-25
 
 2 of Act 91, Session Laws of Hawaii 1999.
 
 3      SECTION 4.  The sum appropriated in 3(1) shall be expended
 
 4 by the department of health for the purposes of this Act.  The
 
 5 sums authorized by 3(2) and 3(3) shall be expended by the
 
 6 department of human services for the purposes of this Act.
 
 7      SECTION 5.  This Act shall take effect upon its approval.
