                   A  BILL  FOR  AN  ACT

RELATING TO CHILD AND ADOLESCENT MENTAL HEALTH.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  This Act is recommended by the governor for
 
 2 immediate passage in accordance with section 9 of article VII of
 
 3 the Constitution of the State of Hawaii.
 
 4      SECTION 2.  Although funds were appropriated to the
 
 5 department of health for the child and adolescent mental health
 
 6 division for the fiscal period beginning July 1, 1999, and ending
 
 7 June 30, 2000, a critical funding emergency now exists.  The
 
 8 program will expend all appropriated general and special funds
 
 9 before the end of the current fiscal year, and the department
 
10 will be unable to meet its fiscal obligation to provide services
 
11 to certain emotionally disturbed children and adolescents.  The
 
12 increases in case referrals, services, and court-directed
 
13 placements are the primary contributing factors to this financial
 
14 situation.  The purpose of this Act is to appropriate additional
 
15 general and special fund moneys to allow the child and adolescent
 
16 mental health division to continue to provide services to certain
 
17 emotionally disturbed children and adolescents.
 
18      SECTION 3.  There is appropriated out of the general
 
19 revenues of the State of Hawaii the sum of $17,735,924, or so
 
20 much thereof as may be necessary for fiscal year 1999-2000, to be

 1 used in support of services provided to certain emotionally
 
 2 disturbed children and adolescents.
 
 3      SECTION 4.  There is appropriated out of the child and
 
 4 adolescent mental health special fund the sum of $378,646, or so
 
 5 much thereof as may be necessary for fiscal year 1999-2000, to be
 
 6 used in support of services provided to certain emotionally
 
 7 disturbed children and adolescents.
 
 8      SECTION 5.  There is appropriated out of the behavioral
 
 9 health administration special fund the sum of $38,866, or so much
 
10 thereof as may be necessary for fiscal year 1999-2000, to be used
 
11 in support of services provided to certain emotionally disturbed
 
12 children and adolescents.
 
13      SECTION 6.  The sums appropriated in this Act shall be
 
14 expended by the department of health for the purposes of this
 
15 Act.
 
16      SECTION 7.  For the purposes of the child and adolescent
 
17 mental health program and for the program for services provided
 
18 to certain emotionally disturbed children and adolescents:
 
19      (1)  None of the sums appropriated for these programs shall
 
20           be expended for any sex offender treatment program
 
21           located within 3,000 feet of any school campus in
 
22           Hawaii;
 
23      (2)  Of the sums appropriated for the child and adolescent

 1           mental health division (HTH 460), a minimum of ten per
 
 2           cent of the funds to be expended for any new treatment
 
 3           or service programs shall be expended by the department
 
 4           of health for the purpose of conducting process and
 
 5           outcome evaluations of these programs;
 
 6      (3)  The process and outcome evaluations required under (2)
 
 7           shall be conducted for the department of health by an
 
 8           independent evaluator;
 
 9      (4)  The department of health shall submit reports of the
 
10           process and outcome evaluations:
 
11           (A)  To the legislature no later than twenty days prior
 
12                to the convening of the regular session of 2002;
 
13                and
 
14           (B)  To the auditor, at any time, upon the request of
 
15                the auditor;
 
16      (5)  The auditor shall monitor the conduct of the process
 
17           and outcome evaluations and report its findings and
 
18           recommendations to the legislature or the department of
 
19           health, or both, whenever or as deemed necessary; and
 
20      (6)  The department of health shall not relocate any
 
21           emotionally disturbed child or adolescent living on the
 
22           mainland, pursuant to a treatment program, to Hawaii
 
23           unless the service provider agrees that relocation is

 1           in the best interests of the child and treatment is
 
 2           less costly in Hawaii.
 
 3      SECTION 8.  This Act shall take effect upon its approval.
