                   A  BILL  FOR  AN  ACT

RELATING TO THE STATE INTERNET PORTAL.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Findings and purpose.  The legislature finds
 
 2 that the expansion of the internet has fundamentally transformed
 
 3 society and the conduct of business.  In order to better serve
 
 4 citizens and businesses in the new economy, government must
 
 5 expand access to information and services over the internet.
 
 6      The State has entered into a contract with a vendor to
 
 7 establish, develop, operate, maintain, and expand an Internet
 
 8 portal for the purpose of increasing electronic access and
 
 9 commerce among Hawaii residents, businesses, and government
 
10 entities.  At no cost to the State, the portal manager will
 
11 provide all necessary hardware, software, portal infrastructure,
 
12 administration, operation, systems analysis, programming,
 
13 delivery of services, training, marketing, collection and
 
14 distribution of payments, and a help desk.
 
15      All statutory fees collected by the portal manager on behalf
 
16 of a government agency will be remitted in full to the government
 
17 agency.  All charges for value added electronic services will be
 
18 retained by the portal manager to pay for the core and ongoing
 
19 costs of operating the portal as well as applications development

 1 costs associated with the deployment of standard and premium
 
 2 services.
 
 3      The purpose of this Act is to establish a mechanism for
 
 4 oversight of the portal manager and authorize the setting of
 
 5 charges for value added electronic services that will be
 
 6 collected by the portal manager.
 
 7      SECTION 2.  Definitions.  As used in this Act, unless the
 
 8 context otherwise requires:
 
 9      "Committee" means the Access Hawaii Committee.
 
10      "Internet" means the global information system that is
 
11 logically linked together by a globally unique address space
 
12 based on the Internet Protocol (IP), or its subsequent
 
13 extensions; and that is able to support communications using the
 
14 Transmission Control Protocol/Internet Protocol (TCP/IP) suite,
 
15 or its subsequent extensions, or other IP-compatible protocols;
 
16 and that provides, uses, or makes accessible, either publicly or
 
17 privately, information to users.
 
18      "Internet portal" means the centralized electronic
 
19 information system by which public information is provided via
 
20 dial-in modem or continuous link to the public through
 
21 subscription or through public libraries.
 
22      "Government agency" means any government agency that stores,
 
23 gathers, or generates public information, including all branches

 1 of government, all executive departments, boards, and commissions
 
 2 of the State or counties, and all public corporations created by
 
 3 the legislature.
 
 4      "Portal manager" means the entity or person engaged to
 
 5 manage and operate the internet portal on behalf of the State of
 
 6 Hawaii.
 
 7      "Value added electronic services" means services including,
 
 8 but not limited to:
 
 9      (1)  Providing periodic, continual and ongoing access to
 
10           information maintained by a government agency without
 
11           requiring separate requests for information as it is
 
12           created;
 
13      (2)  Compiling data or performing other research services;
 
14           or
 
15      (3)  Permitting the electronic filing of reports, renewals,
 
16           or applications.
 
17      SECTION 3.  Access Hawaii Committee; establishment;
 
18 membership; chairperson.(a)  There is established within the
 
19 office of the governor, on a special and temporary basis, the
 
20 Access Hawaii Committee, until June 30, 2003, at which time the
 
21 committee shall cease to exist.
 
22      (b)  The committee shall consist of up to nine voting ex
 
23 officio members, or designated representatives, as follows: the

 1 governor's special advisor for technology development, the
 
 2 administrator of the information and communication services
 
 3 division in the department of accounting and general services,
 
 4 the administrator of the state procurement office, the director
 
 5 of the office of information practices, the director of the
 
 6 department of commerce and consumer affairs, and the chief
 
 7 information officers of the four counties.
 
 8      (c)  The governor's special advisor for technology
 
 9 development shall serve as the chairperson of the committee.
 
10      SECTION 4.  Duties of the committee.  The committee shall
 
11 provide oversight of the portal manager including:
 
12      (1)  Review of the annual strategic plan and periodic
 
13           reports on potential new applications and services
 
14           submitted by the portal manager;
 
15      (2)  Review and approval of all charges to portal users;
 
16      (3)  Review and approval of service level agreements
 
17           negotiated by government agencies with the portal
 
18           manager;
 
19      (4)  Review of annual financial reports and audit of the
 
20           portal manager;
 
21      (5)  Review of annual customer satisfaction surveys
 
22           conducted by the portal manager; and
 
23      (6)  Review of performance measures of the portal submitted

 1           as part of the service management plan for portal-wide
 
 2           indicators and application specific indicators.
 
 3      SECTION 5.  Annual report.  The committee shall submit an
 
 4 annual report on the operations of the portal to the legislature
 
 5 twenty days prior to the convening of each regular legislative
 
 6 session.
 
 7      SECTION 6.  Statutory material to be repealed is bracketed.
 
 8 New statutory material is underscored.
 
 9      SECTION 7.  This Act shall take effect upon its approval.
