                   A  BILL  FOR  AN  ACT

RELATING TO STATE FINANCES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature determines that there is in the
 
 2 state risk management revolving fund at least $          in
 
 3 excess of the requirements of the fund.  There is hereby
 
 4 authorized and appropriated from the retained earnings in the
 
 5 state risk management revolving fund created by section 41D-4,
 
 6 Hawaii Revised Statutes, the sum of $          for fiscal year
 
 7 2000-2001, to be deposited into the general fund.
 
 8      SECTION 2.  The legislature determines that there is in the
 
 9 works of art special fund at least $          in excess of the
 
10 requirements of the fund.  There is hereby authorized and
 
11 appropriated from the retained earnings in the works of art
 
12 special fund created by section 103-8.5, Hawaii Revised Statutes,
 
13 the sum of $          for fiscal year 2000-2001, to be deposited
 
14 into the general fund.
 
15      SECTION 3.  The legislature determines that there is in the
 
16 environmental response revolving fund at least $          in
 
17 excess of the requirements of the fund.  There is hereby
 
18 authorized and appropriated from the retained earnings in the
 
19 environmental response revolving fund created by section 128D-2,

 1 Hawaii Revised Statutes, the sum of $          for fiscal year
 
 2 2000-2001, to be deposited into the general fund.
 
 3      SECTION 4.  The legislature determines that there is in the
 
 4 irrigation system revolving fund at least $          in excess of
 
 5 the requirements of the fund.  There is hereby authorized and
 
 6 appropriated from the retained earnings in the irrigation system
 
 7 revolving fund created by section 167-22, Hawaii Revised
 
 8 Statutes, the sum of $          for fiscal year 2000-2001, to be
 
 9 deposited into the general fund.
 
10      SECTION 5.  The legislature determines that there is in the
 
11 industrial park special fund at least $          in excess of the
 
12 requirements of the fund.  There is hereby authorized and
 
13 appropriated from the retained earnings in the industrial park
 
14 special fund created by section 171-138, Hawaii Revised Statutes,
 
15 the sum of $          for fiscal year 2000-2001, to be deposited
 
16 into the general fund.
 
17      SECTION 6.  The legislature determines that there is in the
 
18 wildlife revolving fund at least $          in excess of the
 
19 requirements of the fund.  There is hereby authorized and
 
20 appropriated from the retained earnings in the wildlife revolving
 
21 fund created by section 183D-10.5, Hawaii Revised Statutes, the
 
22 sum of $          for fiscal year 2000-2001, to be deposited into

 1      SECTION 7.  The legislature determines that there is in the
 
 2 aina hoomalu special fund at least $          in excess of the
 
 3 requirements of the fund.  There is hereby authorized and
 
 4 appropriated from the retained earnings in the aina hoomalu
 
 5 special fund created by section 184-32, Hawaii Revised Statutes,
 
 6 the sum of $          for fiscal year 2000-2001, to be deposited
 
 7 into the general fund.
 
 8      SECTION 8.  The legislature determines that there is in the
 
 9 forest stewardship fund at least $          in excess of the
 
10 requirements of the fund.  There is hereby authorized and
 
11 appropriated from the retained earnings in the forest stewardship
 
12 fund created by section 195F-4, Hawaii Revised Statutes, the sum
 
13 of $          for fiscal year 2000-2001, to be deposited into the
 
14 general fund.
 
15      SECTION 9.  The legislature determines that there is in the
 
16 housing finance revolving fund at least $          in excess of
 
17 the requirements of the fund.  There is hereby authorized and
 
18 appropriated from the retained earnings in the housing finance
 
19 revolving fund created by section 201G-170, Hawaii Revised
 
20 Statutes, the sum of $          for fiscal year 2000-2001, to be
 
21 deposited into the general fund.
 
22      SECTION 10.  The legislature determines that there is in the
 
23 rental assistance revolving fund at least $          in excess of

 1 the requirements of the fund.  There is hereby authorized and
 
 2 appropriated from the retained earnings in the rental assistance
 
 3 revolving fund created by section 201G-223, Hawaii Revised
 
 4 Statutes, the sum of $          for fiscal year 2000-2001, to be
 
 5 deposited into the general fund.
 
 6      SECTION 11.  The legislature determines that there is in the
 
 7 housing alteration revolving loan fund at least $          in
 
 8 excess of the requirements of the fund.  There is hereby
 
 9 authorized and appropriated from the retained earnings in the
 
10 housing alteration revolving loan fund created by section
 
11 201G-342, Hawaii Revised Statutes, the sum of $          for
 
12 fiscal year 2000-2001, to be deposited into the general fund.
 
13      SECTION 12.  The legislature determines that there is in the
 
14 dwelling unit revolving fund at least $          in excess of the
 
15 requirements of the fund.  There is hereby authorized and
 
16 appropriated from the retained earnings in the dwelling unit
 
17 revolving fund created by section 201G-411, Hawaii Revised
 
18 Statutes, the sum of $          for fiscal year 2000-2001, to be
 
19 deposited into the general fund.
 
20      SECTION 13.  The legislature determines that there is in the
 
21 homes revolving fund at least $          in excess of the
 
22 requirements of the fund.  There is hereby authorized and
 
23 appropriated from the retained earnings in the homes revolving

 1 fund created by section 201G-401, Hawaii Revised Statutes, the

 4      SECTION 14.  The legislature determines that there is in the
 
 5 Hawaii development revolving fund at least $          in excess
 
 6 of the requirements of the fund.  There is hereby authorized and
 
 7 appropriated from the retained earnings in the Hawaii development
 
 8 revolving fund created by section 201G-421, Hawaii Revised
 
 9 Statutes, the sum of $          for fiscal year 2000-2001, to be
 
10 deposited into the general fund.
 
11      SECTION 15.  The legislature determines that there is in the
 
12 high technology special fund at least $          in excess of the
 
13 requirements of the fund.  There is hereby authorized and
 
14 appropriated from the retained earnings in the high technology
 
15 special fund created by section 206M-15.5, Hawaii Revised
 
16 Statutes, the sum of $          for fiscal year 2000-2001, to be
 
17 deposited into the general fund.
 
18      SECTION 16.  The legislature determines that there is in the
 
19 convention center capital and operations special fund at least
 
20 $          in excess of the requirements of the fund.  There is
 
21 hereby authorized and appropriated from the retained earnings in
 
22 the convention center capital and operations special fund created
 
23 by section 206X-10.5, Hawaii Revised Statutes, the sum of

 1 $          for fiscal year 2000-2001, to be deposited into the
 
 2 general fund.
 
 3      SECTION 17.  The legislature determines that there is in the
 
 4 Hawaii community-based economic development revolving fund at
 
 5 least $          in excess of the requirements of the fund.
 
 6 There is hereby authorized and appropriated from the retained
 
 7 earnings in the Hawaii community-based economic development
 
 8 revolving fund created by section 201D-4, Hawaii Revised
 
 9 Statutes, the sum of $          for fiscal year 2000-2001, to be
 
10 deposited into the general fund.
 
11      SECTION 18.  The legislature determines that there is in the
 
12 natural energy laboratory of Hawaii authority special fund at
 
13 least $          in excess of the requirements of the fund.
 
14 There is hereby authorized and appropriated from the retained
 
15 earnings in the natural energy laboratory of Hawaii authority
 
16 special fund created by section 227D-5, Hawaii Revised Statutes,
 
17 the sum of $          for fiscal year 2000-2001, to be deposited
 
18 into the general fund.
 
19      SECTION 19.  The legislature determines that there is in the
 
20 storeroom revolving fund at least $          in excess of the
 
21 requirements of the fund.  There is hereby authorized and
 
22 appropriated from the retained earnings in the storeroom
 
23 revolving fund created by section 302A-1304, Hawaii Revised

 1 Statutes, the sum of $          for fiscal year 2000-2001, to be
 
 2 deposited into the general fund.
 
 3      SECTION 20.  The legislature determines that there is in the
 
 4 library special fund at least $          in excess of the
 
 5 requirements of the fund.  There is hereby authorized and
 
 6 appropriated from the retained earnings in the library special
 
 7 fund created by section 304-8.93, Hawaii Revised Statutes, the
 
 8 sum of $          for fiscal year 2000-2001, to be deposited into
 
 9 the general fund.
 
10      SECTION 21.  The legislature determines that there is in the
 
11 conference center revolving fund at least $          in excess of
 
12 the requirements of the fund.  There is hereby authorized and
 
13 appropriated from the retained earnings in the conference center
 
14 revolving fund created by section 304-8.94, Hawaii Revised
 
15 Statutes, the sum of $          for fiscal year 2000-2001, to be
 
16 deposited into the general fund.
 
17      SECTION 22.  The legislature determines that there is in the
 
18 Hawaii opportunity program in education endowment special fund at
 
19 least $          in excess of the requirements of the fund.
 
20 There is hereby authorized and appropriated from the retained
 
21 earnings in the Hawaii opportunity program in education endowment
 
22 special fund created by section 304-8.95, Hawaii Revised
 
23 Statutes, the sum of $          for fiscal year 2000-2001, to be

 1 deposited into the general fund.
 
 2      SECTION 23.  The legislature determines that there is in the
 
 3 housing assistance revolving fund at least $          in excess
 
 4 of the requirements of the fund.  There is hereby authorized and
 
 5 appropriated from the retained earnings in the housing assistance
 
 6 revolving fund created by section 304-8.96, Hawaii Revised
 
 7 Statutes, the sum of $          for fiscal year 2000-2001, to be
 
 8 deposited into the general fund.
 
 9      SECTION 24.  The legislature determines that there is in the
 
10 University of Hawaii alumni revolving fund at least $          in
 
11 excess of the requirements of the fund.  There is hereby
 
12 authorized and appropriated from the retained earnings in the
 
13 University of Hawaii alumni revolving fund created by section
 
14 304-8.97, Hawaii Revised Statutes, the sum of $          for
 
15 fiscal year 2000-2001, to be deposited into the general fund.
 
16      SECTION 25.  The legislature determines that there is in the
 
17 state aquarium special fund at least $          in excess of the
 
18 requirements of the fund.  There is hereby authorized and
 
19 appropriated from the retained earnings in the state aquarium
 
20 special fund created by section 304-33, Hawaii Revised Statutes,
 
21 the sum of $          for fiscal year 2000-2001, to be deposited
 
22 into the general fund.
 
23      SECTION 26.  The legislature determines that there is in the

 1 libraries special fund at least $          in excess of the
 
 2 requirements of the fund.  There is hereby authorized and
 
 3 appropriated from the retained earnings in the libraries special
 
 4 fund created by section 312-3.6, Hawaii Revised Statutes, the sum
 
 5 of $          for fiscal year 2000-2001, to be deposited into the
 
 6 general fund.
 
 7      SECTION 27.  The legislature determines that there is in the
 
 8 Hawaii registered nurse student loan fund at least $          in
 
 9 excess of the requirements of the fund.  There is hereby
 
10 authorized and appropriated from the retained earnings in the
 
11 Hawaii registered nurse student loan fund created by section
 
12 321-25, Hawaii Revised Statutes, the sum of $          for fiscal
 
13 year 2000-2001, to be deposited into the general fund.
 
14      SECTION 28.  The legislature determines that there is in the
 
15 facility administration fund at least $          in excess of the
 
16 requirements of the fund.  There is hereby authorized and
 
17 appropriated from the retained earnings in the facility
 
18 administration fund created by section 323-73, Hawaii Revised
 
19 Statutes, the sum of $          for fiscal year 2000-2001, to be
 
20 deposited into the general fund.
 
21      SECTION 29.  The legislature determines that there is in the
 
22 mental health and substance abuse special fund at least
 
23 $          in excess of the requirements of the fund.  There is

 1 hereby authorized and appropriated from the retained earnings in
 
 2 the mental health and substance abuse special fund created by
 
 3 section 334-15, Hawaii Revised Statutes, the sum of $         
 
 4 for fiscal year 2000-2001, to be deposited into the general fund.
 
 5      SECTION 30.  The legislature determines that there is in the
 
 6 water pollution control revolving fund at least $          in
 
 7 excess of the requirements of the fund.  There is hereby
 
 8 authorized and appropriated from the retained earnings in the
 
 9 water pollution control revolving fund created by section
 
10 342D-83, Hawaii Revised Statutes, the sum of $          for
 
11 fiscal year 2000-2001, to be deposited into the general fund.
 
12      SECTION 31.  The legislature determines that there is in the
 
13 correctional industries revolving fund at least $          in
 
14 excess of the requirements of the fund.  There is hereby
 
15 authorized and appropriated from the retained earnings in the
 
16 correctional industries revolving fund created by section
 
17 354D-10, Hawaii Revised Statutes, the sum of $          for
 
18 fiscal year 2000-2001, to be deposited into the general fund.
 
19      SECTION 32.  The legislature determines that there is in the
 
20 special unemployment insurance administration fund at least
 
21 $          in excess of the requirements of the fund.  There is
 
22 hereby authorized and appropriated from the retained earnings in
 
23 the special unemployment insurance administration fund created by

 1 section 383-127, Hawaii Revised Statutes, the sum of $         
 
 2 for fiscal year 2000-2001, to be deposited into the general fund.
 
 3      SECTION 33.  The legislature determines that there is in the
 
 4 employment and training fund at least $          in excess of the
 
 5 requirements of the fund.  There is hereby authorized and
 
 6 appropriated from the retained earnings in the employment and
 
 7 training fund created by section 383-128, Hawaii Revised
 
 8 Statutes, the sum of $          for fiscal year 2000-2001, to be
 
 9 deposited into the general fund.
 
10      SECTION 34.  The legislature determines that there is in the
 
11 commissioner's education and training fund at least $          in
 
12 excess of the requirements of the fund.  There is hereby
 
13 authorized and appropriated from the retained earnings in the
 
14 commissioner's education and training fund created by section
 
15 431:2-214, Hawaii Revised Statutes, the sum of $          for
 
16 fiscal year 2000-2001, to be deposited into the general fund.
 
17      SECTION 35.  The legislature determines that there is in the
 
18 special drivers education fund account at least $          in
 
19 excess of the requirements of the fund.  There is hereby
 
20 authorized and appropriated from the retained earnings in the
 
21 special drivers education fund account created by section
 
22 431:10C-115, Hawaii Revised Statutes, the sum of $          for
 
23 fiscal year 2000-2001, to be deposited into the general fund.

 1      SECTION 36.  The legislature determines that there is in the
 
 2 condominium management education fund at least $          in
 
 3 excess of the requirements of the fund.  There is hereby
 
 4 authorized and appropriated from the retained earnings in the
 
 5 condominium management education fund created by section
 
 6 514A-131, Hawaii Revised Statutes, the sum of $          for
 
 7 fiscal year 2000-2001, to be deposited into the general fund.
 
 8      SECTION 37.  The legislature determines that there is in the
 
 9 supreme court law library revolving fund at least $          in
 
10 excess of the requirements of the fund.  There is hereby
 
11 authorized and appropriated from the retained earnings in the
 
12 supreme court law library revolving fund created by section
 
13 601-3.5, Hawaii Revised Statutes, the sum of $          for
 
14 fiscal year 2000-2001, to be deposited into the general fund.
 
15      SECTION 38.  The legislature determines that there is in the
 
16 criminal forfeiture fund at least $          in excess of the
 
17 requirements of the fund.  There is hereby authorized and
 
18 appropriated from the retained earnings in the criminal
 
19 forfeiture fund created by section 712A-16, Hawaii Revised
 
20 Statutes, the sum of $          for fiscal year 2000-2001, to be
 
21 deposited into the general fund.
 
22      SECTION 39.  The legislature determines that there is in the
 
23 state educational facilities improvement special fund at least

 1 $          in excess of the requirements of the fund.  There is
 
 2 hereby authorized and appropriated from the retained earnings in
 
 3 the state educational facilities improvement special fund created
 
 4 by section 36-32, Hawaii Revised Statutes, the sum of $         
 
 5 for fiscal year 2000-2001, to be deposited into the general fund.
 
 6      SECTION 40.  The legislature determines that there is in the
 
 7 irrigation system revolving fund at least $          in excess of
 
 8 the requirements of the fund.  There is hereby authorized and
 
 9 appropriated from the retained earnings in the irrigation system
 
10 revolving fund created by section 167-22, Hawaii Revised
 
11 Statutes, the sum of $          for fiscal year 2000-2001, to be
 
12 deposited into the general fund.
 
13      SECTION 41.  It is the intent of this Act not to jeopardize
 
14 the receipt of any federal aid nor to impair the obligation of
 
15 the State or any agency thereof to the holders of any bond issued
 
16 by the State or any such agency, and to the extent, and only to
 
17 the extent, necessary to effectuate this intent, the governor may
 
18 modify the strict provisions of this Act, but shall promptly
 
19 report any such modification with reasons therefor to the
 
20 legislature.
 
21      SECTION 42.  If any provision of this Act, or the
 
22 application thereof to any person or circumstance is held
 
23 invalid, the invalidity does not affect other provisions or
 
24 applications of the Act which can be given effect without the

 1 invalid provision or application, and to this end the provisions
 
 2 of this Act are severable.
 
 3      SECTION 43.  This Act shall take effect on July 1, 2000.
