                   A  BILL  FOR  AN  ACT

RELATING TO GEOGRAPHIC INFORMATION SYSTEMS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to establish a
 
 2 special fund to help support the operation and maintenance of the
 
 3 statewide planning and geographic information system and to
 
 4 authorize the office of planning to charge fees for spatial
 
 5 analysis services.
 
 6      SECTION 2.  Chapter 225M, Hawaii Revised Statutes, is
 
 7 amended by adding two new sections to be appropriately designated
 
 8 and to read as follows:
 
 9      "§225M-    Statewide planning and geographic information
 
10 system special fund.  (a)  There is established in the state
 
11 treasury the statewide planning and geographic information system
 
12 special fund, into which shall be deposited:
 
13      (1)  Moneys collected as fees for geographic information
 
14           system services rendered;
 
15      (2)  Moneys directed, allocated, or disbursed to the
 
16           statewide planning and geographic information system
 
17           program from other government agencies or private
 
18           sources;
 
19      (3)  Moneys collected as fees for the convenience of
 
20           obtaining data and products via the internet; and

 1      (4)  Moneys directed, allocated, or disbursed to the
 
 2           statewide planning and geographic information system
 
 3           program from non state sources, including grants,
 
 4           awards, and donations.
 
 5      (b)  The statewide planning and geographic information
 
 6 system special fund shall be used to help defray the costs of the
 
 7 following:
 
 8      (1)  Programs and activities to implement this chapter,
 
 9           including the provision of state funds to match federal
 
10           funds from the United States Geological Survey or other
 
11           federal departments; and
 
12      (2)  Operating costs of the system, including compensation
 
13           of staff and acquisition and maintenance of hardware or
 
14           software necessary to implement this chapter.
 
15      (c)  Investment earnings credited to the assets of the fund
 
16 shall become a part of the assets of the fund.
 
17      §225M-    Fees for statewide geographic information system
 
18 services.  The office of planning may charge fees for statewide
 
19 geographic information system services.  All fees collected for
 
20 geographic information system analyses and other related services
 
21 shall be deposited into the statewide planning and geographic
 
22 information system special fund.  The office shall adopt rules
 
23 pursuant to chapter 91 setting fees for geographic information
 
24 system services."

 1      SECTION 3.  There is appropriated out of the statewide
 
 2 planning and geographic information system special fund the sum
 
 3 of $1 or so much thereof as may be necessary for fiscal year
 
 4 2000-200l to be expended for the purposes of the statewide
 
 5 planning and geographic information system.
 
 6      SECTION 4.  The sum appropriated shall be expended by the
 
 7 office of planning for the purposes of this Act.
 
 8      SECTION 5.  New statutory material is underscored.
 
 9      SECTION 6.  This Act shall take effect on July 1, 2000.
