                   A  BILL  FOR  AN  ACT

RELATING TO A CHIEF FINANCIAL OFFICER FOR THE DEPARTMENT OF
   EDUCATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 302A-1101, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]§302A-1101[]]  Department of education; board of
 
 4 education; superintendent of education[.]; chief financial
 
 5 officer.  (a)  There shall be a principal executive department to
 
 6 be known as the department of education, which shall be headed by
 
 7 an elected policy-making board to be known as the board of
 
 8 education.  The board shall have power in accordance with law to
 
 9 formulate statewide educational policy, adopt student performance
 
10 standards and assessment models, monitor school success, and to
 
11 appoint the superintendent of education as the chief executive
 
12 officer of the public school system.
 
13      (b)  The board shall appoint, and may remove, the
 
14 superintendent by a majority vote of its members.  The
 
15 superintendent:
 
16      (1)  May be appointed without regard to the state residency
 
17           provisions of section 78-1(b);
 
18      (2)  May be appointed for a term of up to four years; and
 
19      (3)  May be terminated only for cause.

 1      (c)  A chief financial officer of the public school system
 
 2 shall be appointed by the superintendent of education.  The chief
 
 3 financial officer shall operate under the direction of the
 
 4 superintendent and shall be responsible for the accurate and
 
 5 relevant collection and reporting of financial information on the
 
 6 public school system."
 
 7      SECTION 2.  There is appropriated out of the general
 
 8 revenues of the State of Hawaii the sum of $        , or so much
 
 9 thereof as may be necessary for fiscal year 2000-2001, for the
 
10 creation of a chief financial officer of the public school
 
11 system.
 
12      SECTION 3.  The sum appropriated shall be expended by the
 
13 department of education for the purposes of this Act.
 
14      SECTION 4.  Statutory material to be repealed is bracketed.
 
15 New statutory material is underscored.
 
16      SECTION 5.  This Act shall take effect on July 1, 2000.
