REPORT TITLE:
Public School Facilities


DESCRIPTION:
Exempts the acquisition of school facilities by leases from the
law relating to the management of financing agreements.  Requires
the DOE to enter into a lease agreement with the Maui Research
and Technology Park or the Haleakala Ranch Company, or both, for

                   A  BILL  FOR  AN  ACT

RELATING TO PUBLIC SCHOOL FACILITIES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 302A-1506, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]§302A-1506[]]  Public school facilities.  [The]
 
 4 Notwithstanding chapter 37D to the contrary, the department may
 
 5 enter into such contracts, leases, lease-purchase agreements, or
 
 6 other transactions as may be necessary for the acquisition of
 
 7 public school facilities, including any lands for these
 
 8 facilities, on such terms as [it] the department may deem
 
 9 appropriate, subject to approval by the [comptroller.] board."
 
10      SECTION 2.  Notwithstanding chapter 37D and section
 
11 302A-1506, Hawaii Revised Statutes, to the contrary, the
 
12 department of education shall enter into a lease agreement with
 
13 the Maui Research and Technology Park or the Haleakala Ranch
 
14 Company, or both, for the acquisition of Kihei charter public
 
15 high school, subject to approval by the board of education.
 
16      SECTION 3.  Statutory material to be repealed is bracketed.
 
17 New statutory material is underscored.
