Minor; Liquor Purchase


DESCRIPTION:
Suspends driver's license for 6 months, requires 100 hours of
community service and attendance at alcohol and drug education
program if an underage person violates liquor laws.  For repeat
offenders, suspends driver's license for 1 year and 150 hours of

                   A  BILL  FOR  AN  ACT

RELATING TO INTOXICATING LIQUOR.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 281-101.5, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (d) to read as follows:
 
 3      "(d)  Any person under age eighteen who violates this
 
 4 section shall be subject to the jurisdiction of the family court.
 
 5 If the family court determines that the person violated this
 
 6 section, the person's driver's license shall be suspended for six
 
 7 months, the person shall perform one hundred hours of offense-
 
 8 related community service and, accompanied by a parent or
 
 9 guardian, attend an alcohol and drug education program provided
 
10 by the court.  Any person age eighteen or older who violates
 
11 subsection (a) shall be guilty of a misdemeanor.  Any person age
 
12 eighteen to twenty-one who violates [subsections] subsection (b)
 
13 or (c) shall be guilty of a petty misdemeanor.  Any person age
 
14 eighteen to twenty-one who violates this section, in addition to
 
15 any other penalty imposed, shall have the person's driver's
 
16 license suspended for six months and be required to perform one
 
17 hundred hours of offense-related community service and attend an
 
18 alcohol and drug education program provided by the court.
 
19      For repeat offenses under subsection (b) or (c), the

 1 person's driver's license shall be suspended for one year and the
 
 2 person shall perform one hundred fifty hours of offense-related
 
 3 community service."
 
 4      SECTION 2.  This Act does not affect rights and duties that
 
 5 matured, penalties that were incurred, and proceedings that were
 
 6 begun, before its effective date.
 
 7      SECTION 3.  Statutory material to be repealed is bracketed.
 
 8 New statutory material is underscored.
 
 9      SECTION 4.  This Act shall take effect upon its approval.
