DESCRIPTION:
Appropriates $1 in capital improvement project funds each, for
every elementary school in Hawaii, to purchase, construct, and

                   A  BILL  FOR  AN  ACT

RELATING TO CAPITAL IMPROVEMENT PROJECTS FOR THE BENEFIT OF ALL
   REPRESENTATIVE DISTRICTS IN THE STATE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  (a)  The following sums, or so much thereof as
 
 2 shall be sufficient to finance the projects listed in this Act,
 
 3 are hereby appropriated out of the general revenues of the State
 
 4 of Hawaii for fiscal year 2000-2001.  There is appropriated to
 
 5 each elementary school in the State the sum of $1, or so much
 
 6 thereof as may be necessary, to purchase, construct, and install
 
 7 new and safe playground equipment and appropriate ground
 
 8 surfacing that comply with:
 
 9      (1)  The Americans with Disabilities Act;
 
10      (2)  Voluntary guidelines established by the American
 
11           Society for Testing and Materials; and
 
12      (3)  The United States Consumer Product Safety Commission;
 
13 provided that if any elementary school in the State has already
 
14 purchased, constructed, or installed playground equipment and
 
15 ground surfacings that currently meet the standards listed above,
 
16 that school's parent-teacher organization, or similar
 
17 association, may use the appropriated amount for other capital
 
18 improvement project-related improvements for the school, as
 
19 deemed appropriate by that school's principal.

 1      (b)  The department of education and the department of
 
 2 accounting and general services shall construct, purchase, and
 
 3 install the playground equipment and ground surfacings in the
 
 4 most cost-effective manner possible.

13      SECTION 2.  The sums appropriated for the respective capital
 
14 projects set forth in section 1 shall be expended by the
 
15 designated expending agency for the purposes of this Act.
 
16      SECTION 3.  This Act shall take effect on July 1, 2000.
