Teachers Right to Know Act


DESCRIPTION:
Requires the amount of all wages, salaries, and paid benefits
being provided to all persons employed by the public employee
organizations for teachers and educational officers to be (1)
certified by a certified public accountant, and (2) made

                   A  BILL  FOR  AN  ACT

RELATING TO TEACHERS' RIGHT TO KNOW ACT.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 89, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§89-     Financial and other reports to employees; teachers
 
 5 and educational officers.  (a)  Each employee organization shall
 
 6 keep an adequate record of its financial transactions and shall
 
 7 make available annually, at no cost to employees who are members
 
 8 of bargaining unit (5) and bargaining unit (6), respectively,
 
 9 within sixty days after the end of the organization's fiscal
 
10 year, a detailed written financial report thereof in the form of
 
11 a balance sheet and an operating statement, certified as to
 
12 accuracy by a certified public accountant.
 
13      For the purposes of this section, "employee organization"
 
14 means the exclusive representative of bargaining unit (5) and the
 
15 exclusive representative of bargaining unit (6), respectively.
 
16      (b)  The financial report described in subsection (a) shall
 
17 include the amount of all wages, salaries, and paid benefits
 
18 being provided to all persons employed by the respective employee
 
19 organization.

 1      For the purposes of this section, "paid benefits" means any
 
 2 payment by an employee organization to a person currently or
 
 3 formerly employed by the organization, or to a dependent of a
 
 4 person currently or formerly employed by the organization, that
 
 5 would not have been made if the person had not been employed by
 
 6 the organization.  The term does not include any payment from any
 
 7 insurance trust or fund that is offset by previous payments by
 
 8 the employee organization or by a person employed by the
 
 9 organization.
 
10      (c)  In the event of failure to comply with this section, an
 
11 employee who is a member of bargaining unit (5) or bargaining
 
12 unit (6) may petition the board for an order compelling the
 
13 respective employee organization to comply.  An order of the
 
14 board on the petition shall be enforceable in the same manner as
 
15 other orders of the board under this chapter."
 
16      SECTION 2.  Section 89-15, Hawaii Revised Statutes, is
 
17 amended to read as follows:
 
18      "§89-15  Financial reports to employees.  (a)  Every
 
19 employee organization shall keep an adequate record of its
 
20 financial transactions and shall make available annually, to the
 
21 employees who are members of the organization, within sixty days

 1 report thereof in the form of a balance sheet and an operating
 
 2 statement, certified as to accuracy by a certified public
 
 3 accountant.  In the event of failure of compliance with this
 
 4 section, any employee within the organization may petition the
 
 5 board for an order compelling such compliance.  An order of the
 
 6 board on such petition shall be enforceable in the same manner as
 
 7 other orders of the board under this chapter.
 
 8      (b)  This section shall not apply to the exclusive
 
 9 representative of bargaining unit (5) or the exclusive
 
10 representative of bargaining unit (6)."
 
11      SECTION 3.  If any provision of this Act, or the application
 
12 thereof to any person or circumstance is held invalid, the
 
13 invalidity does not affect other provisions or applications of
 
14 the Act which can be given effect without the invalid provision
 
15 or application, and to this end the provisions of this Act are
 
16 severable.
 
17      SECTION 4.  New statutory material is underscored.
 
18      SECTION 5.  This Act shall take effect upon its approval.
