                   A  BILL  FOR  AN  ACT

RELATING TO THE MODERNIZATION OF THE POSITION CLASSIFICATION
   SYSTEM AND PLAN FOR THE CIVIL SERVICE SYSTEM.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that a traditional
 
 2 position classification plan for the State's civil service
 
 3 system, as prescribed by the current statutes, was the only
 
 4 accepted methodology in the 1950s.  Consequently, the statutes
 
 5 now require the classification plan to contain classes of work
 
 6 that must be described in terms of class specifications with
 
 7 specific, detailed characteristics.  The statutes also require
 
 8 other specific actions to be taken in the classification of
 
 9 positions and specify the effective date of these actions.  Since
 
10 the 1950s, alternative methodologies (e.g., broadbanding and
 
11 quantified systems) have been developed and presently offer
 
12 advantages in timeliness, appropriateness, and flexibility.
 
13      The legislature finds that giving the director of human
 
14 resources development the flexibility to revise the existing
 
15 position classification plan, beginning with a few departments,
 
16 would better reflect current methodologies and alternative
 
17 approaches and would improve the State's civil service system.
 
18      The purpose of this Act is to allow the director of human
 
19 resources development to revise the civil service position

 1 classification system and plan for positions in the departments
 
 2 of health, human services, and education.
 
 3      SECTION 2.  Notwithstanding any other law to the contrary,
 
 4 the director of human resources development may revise the
 
 5 position classification system and plan for positions in the
 
 6 departments of health, human services, and education.  In
 
 7 revising the position classification system and plan, the
 
 8 director of human resources development shall:
 
 9      (1)  Create and adjust classes of positions and adopt class
 
10           specifications using professionally recognized
 
11           techniques to identify the title, description of
 
12           typical duties and responsibilities, statement of
 
13           training and experience, and other requirements to be
 
14           met by applicants for each class;
 
15      (2)  Establish and maintain classes or other appropriate
 
16           occupational categories and necessary guidelines and
 
17           procedures, and assure that positions are properly
 
18           identified and categorized within the system;
 
19      (3)  Allocate each existing position and each newly created
 
20           position to the appropriate class or occupational
 
21           category;
 
22      (4)  Reallocate positions to recognize material changes in
 
23           duties and responsibilities or to correct a previous

 1           action; provided that:
 
 2           (A)  Reallocations shall be made effective
 
 3                retroactively to the beginning of the pay period
 
 4                immediately following the date the application for
 
 5                reallocation was filed with the director or any
 
 6                other date provided by rule;
 
 7           (B)  An employee who is otherwise properly compensated
 
 8                shall not be required to reimburse the State for
 
 9                any overpayment in salary if the overpayment is
 
10                due to salary increments or repricing actions
 
11                nullified by the retroactive feature of a
 
12                classification action; and
 
13           (C)  The proper salary adjustment shall be made
 
14                effective as of the first pay period following any
 
15                action taken by the director; and
 
16      (5)  Determine the status of employees holding positions
 
17           affected by actions taken under this Act.
 
18      As used in this Act, unless the context requires otherwise,
 
19 "occupational category" means a grouping of work tasks or
 
20 activities similar in kind or character, identified for
 
21 administrative and human resource management purposes, and
 
22 designated by an official title.
 
23      SECTION 3.  The director of human resources development

 1 shall submit a report to the legislature concerning the status of
 
 2 revisions to the position classification system and plan for
 
 3 positions in the departments of health, human services, and
 
 4 education, no later than twenty days before the convening of the
 
 5 regular session of 2001.
 
 6      SECTION 4.  This Act shall take effect upon its approval.
