REPORT TITLE:
Tobacco Settlement 

DESCRIPTION:
Provides that the funds received by the Health Department from
the Tobacco Settlement for health promotion and disease
prevention programs shall not supplant or diminish the funding of
existing tobacco prevention and control programs or any health

                   A  BILL  FOR  AN  ACT

RELATING TO THE HAWAII TOBACCO SETTLEMENT SPECIAL FUND.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 328L-4, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§328L-4  Use of funds appropriated to the department.  (a)
 
 4 The department, immediately upon receipt of the thirty-five per
 
 5 cent of moneys appropriated pursuant to section 328L-2(b)(2)
 
 6 shall:
 
 7      (1)  Transfer up to ten [percent] per cent of the total
 
 8           moneys received by the State from tobacco settlement
 
 9           moneys to the department of human services for the
 
10           children's health insurance program; and
 
11      (2)  Expend the remainder of the moneys received by the
 
12           department for health promotion and disease prevention
 
13           programs, including but not limited to[,] maternal
 
14           child health and child development programs, promotion
 
15           of healthy lifestyles (including fitness, nutrition,
 
16           and tobacco control), and prevention oriented public
 
17           health programs[.]; provided that the moneys received
 
18           or expended under this paragraph shall not supplant or
 
19           diminish the funding of existing tobacco prevention and
 
20           control programs or any health-related programs funded
 
21           in whole or in part by the State.

 1      (b)  For purposes of this paragraph [(2)], the director
 
 2 shall convene an advisory group that shall be separate from the
 
 3 tobacco prevention and control advisory board, to strategically
 
 4 plan the development and implementation of preventive systems to
 
 5 achieve measurable outcomes and to make recommendations for the
 
 6 expenditure of these moneys.  The advisory group shall be
 
 7 composed of nine members with expertise in the programs under
 
 8 this paragraph [(2)], and shall be selected at the discretion of
 
 9 the director."
 
10      SECTION 2.  Statutory material to be repealed is bracketed.
 
11 New statutory material is underscored.
 
12      SECTION 3.  This Act shall take effect upon its approval.
