DESCRIPTION:
Makes it unlawful for common or contract carriers by motor
vehicle to stop or park vehicles equal to or greater than    feet
in length,    feet in width, and with a turning radius equal to
or greater than    feet on certain roads.  Exempts vehicles used

                   A  BILL  FOR  AN  ACT
RELATING TO THE PUBLIC UTILITIES COMMISSION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 271, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§271-    Permits for common or contract carriers by motor
 
 5 vehicle; special restrictions.  (a)  In each permit or
 
 6 certificate issued by the commission to a common or contract
 
 7 carrier by motor vehicle that operates motor vehicles for the
 
 8 transportation of persons in a county with a population in excess
 
 9 of 500,000, the commission, as a condition of the permit or
 
10 certificate, shall require that the permittee or certificate
 
11 holder abide by the operating restrictions contained in
 
12 subsection (b).
 
13      (b)  No common or contract carrier by motor vehicle
 
14 described in subsection (a) shall park or stop a motor vehicle
 
15 that is equal to or greater than            feet in length,
 
16            feet in width, and has a turning radius equal to or
 
17 greater than            feet on any roadside that:
 
18      (1)  Is adjacent to a state park;
 
19      (2)  Abuts a two-lane road with a single lane for travel in
 
20           each direction and has a single lane width equal to or

 1           less than twelve feet; and
 
 2      (3)  Does not have sufficient space for the motor vehicle to
 
 3           park so as not to impede the regular flow of traffic.
 
 4      (c)  Any common or contract carrier by motor vehicle
 
 5 described in subsection (a) found to be in violation of this
 
 6 section shall be fined as provided in section 271-27 in addition
 
 7 to any other penalty provided by statute or county ordinance
 
 8 relating to highway or traffic safety.
 
 9      (d)  This section shall not apply to:
 
10      (1)  Common or contract carrier motor vehicles that equal or
 
11           exceed the length and turning radius specifications
 
12           stated in subsection (b) that are used for the sole
 
13           purpose of transporting disabled persons; or
 
14      (2)  Cases of medical emergency."
 
15      SECTION 2.  This Act shall apply to all existing public
 
16 utilities commission permittees and certificate holders who are
 
17 common or contract carriers by motor vehicle that operate motor
 
18 vehicles for the transportation of persons in a county with a
 
19 population in excess of 500,000.
 
20      SECTION 3.  New statutory material is underscored.
 
21      SECTION 4.  This Act shall take effect on January 1, 2001.
