                   A  BILL  FOR  AN  ACT

RELATING TO ELECTIONS FOR THE OFFICE OF HAWAIIAN AFFAIRS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 13D-4, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]§13D-4[]]  Election of board members.  (a)  Members of
 
 4 the board of trustees shall be:
 
 5      (1)  Nominated at a special primary election held in
 
 6           conjunction with the primary election; and [elected]
 
 7      (2)  Elected at a special election held in conjunction with
 
 8           the general election;
 
 9 in every even-numbered year.  Except as otherwise provided by
 
10 this chapter, members shall be nominated and elected in the
 
11 manner prescribed by this [title] section.
 
12      Nomination papers.  The chief election officer shall prepare
 
13 the nomination papers in such a manner that a candidate desiring
 
14 to file for election to the board shall be able to specify
 
15 whether the candidate is seeking a seat requiring residency on a
 
16 particular island or a seat without such residency requirement.
 
17      Ballot.  The board of trustees ballot shall be prepared in
 
18 such a manner that every voter qualified and registered under
 
19 section 13D-3 shall be afforded the opportunity to vote for each

 1 and every candidate seeking election to the board.  The ballot
 
 2 shall contain the names of all board candidates arranged
 
 3 alphabetically; provided that the names of candidates seeking
 
 4 seats requiring residency on a particular island shall also be
 
 5 grouped by island of residency.  Each eligible voter shall be
 
 6 entitled to receive the board of trustees ballot and to vote for
 
 7 the number of seats available.
 
 8      (b)  Primary election.  The two candidates receiving the
 
 9 most votes for each available seat with a residency requirement
 
10 shall be nominated for the general election.  If, after the close
 
11 of filing of nomination papers, there are only two qualified
 
12 candidates for a specific seat requiring residency on a
 
13 particular island, the chief election officer shall declare those
 
14 two candidates duly nominated for the general election.  The
 
15 names of those two candidates shall not appear on the primary
 
16 election ballot.  In the event that there is only one qualified
 
17 candidate for any seat requiring residency for a particular
 
18 island, after the close of filing of nomination papers, the chief
 
19 election officer shall declare that candidate to be duly and
 
20 legally elected.
 
21      In the event that the number of qualified candidates for
 
22 seats without a residency requirement is equal to or less than
 
23 the number of such seats to be filled, after the close of filing

 1 of nomination papers, the chief election officer shall declare
 
 2 those candidates to be duly and legally elected.  Otherwise, the
 
 3 eight candidates receiving the most votes for the seats without
 
 4 residency requirements shall be duly nominated by the chief
 
 5 election officer for the general election."
 
 6      SECTION 2.  Statutory material to be repealed is bracketed.
 
 7 New statutory material is underscored.
 
 8      SECTION 3.  This Act shall take effect upon its approval.
