                   A  BILL  FOR  AN  ACT

RELATING TO WORKERS' COMPENSATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 386-25, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (c) to read as follows:
 
 3      "(c)  Enrollment in a rehabilitation plan or program shall
 
 4 not be mandatory and the approval of a proposed rehabilitation
 
 5 plan or program by the injured employee shall be required.   The
 
 6 injured employee may select a certified provider of
 
 7 rehabilitation services.  Both the certified provider and the
 
 8 injured employee, within a reasonable time after initiating
 
 9 rehabilitation services, shall give proper notice of selection to
 
10 the employer.  In the case of an employee who has relocated out
 
11 of the State, the director may approve a provider of
 
12 rehabilitation services who is located in the same area as the
 
13 employee and who has met the certification requirements of that
 
14 state."
 
15      SECTION 2.  This Act does not affect rights and duties that
 
16 matured, penalties that were incurred, and proceedings that were
 
17 begun, before its effective date.
 
18      SECTION 3.  New statutory material is underscored.

 1      SECTION 4.  This Act shall take effect upon its approval.
