                   A  BILL  FOR  AN  ACT
RELATING TO ROBBERY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 708-840, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (1) to read as follows:
 
 3      "(1)  A person commits the offense of robbery in the first
 
 4 degree if, in the course of committing theft:
 
 5      (a)  The person attempts to kill another, or intentionally
 
 6           or knowingly inflicts or attempts to inflict serious
 
 7           bodily injury upon another; [or]
 
 8      (b)  The person is armed with a dangerous instrument and:
 
 9           (i)  The person uses force against the person of anyone
 
10                present with intent to overcome that person's
 
11                physical resistance or physical power of
 
12                resistance; or
 
13          (ii)  The person threatens the imminent use of force
 
14                against the person of anyone who is present with
 
15                intent to compel acquiescence to the taking of or
 
16                escaping with the property[.]; or
 
17      (c)  The person commits a theft of a purse or other
 
18           receptacle attached to the body to carry personal items
 
19           from the person of another, whether or not physical
 
20           force is used."

 1      SECTION2.  Statutory material to be repealed is bracketed.
 
 2 New statutory material is underscored.
