                   A  BILL  FOR  AN  ACT

RELATING TO EDUCATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 304, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§304-    Running start program.  (a)  There is established
 
 5 in the department of education, the running start program to
 
 6 allow eligible students to enroll in any qualified course offered
 
 7 by the University of Hawaii system.
 
 8      (b)  For the purposes of this section:
 
 9      "Eligible student" means a high school student in the
 
10 eleventh or twelfth grade who:
 
11      (1)  Has passed a standardized test administered by the
 
12           college that demonstrates the student's ability to
 
13           succeed at the college level;
 
14      (2)  Is under the age of twenty-one as of September 1 of the
 
15           school year in which the college course is taken; and
 
16      (3)  Possesses other qualifications deemed appropriate by
 
17           the department of education and/or the University of
 
18           Hawaii.
 
19      "Qualified course" means any vocational or academic course

 1 offered by the University of Hawaii system that also applies to
 
 2 the department of education's graduation requirements or is
 
 3 otherwise permitted by department of education rule or policy.
 
 4      (c)  All course credits successfully completed pursuant to
 
 5 this section that would otherwise be transferable but for a
 
 6 student's grade level, shall be transferable to any University of
 
 7 Hawaii system degree granting institution; provided that the
 
 8 student is admitted to the campus where the credit is
 
 9 transferred.
 
10      (d)  College courses successfully completed under this
 
11 section shall also satisfy the department of education's
 
12 graduation requirements as determined by the department of
 
13 education pursuant to rule.
 
14      (e)  This section shall not preclude the department of
 
15 education and the University of Hawaii from establishing programs
 
16 by mutual agreement that permit high school students to enroll in
 
17 college courses.
 
18      (f)  The department of education shall adopt rules pursuant
 
19 to chapter 91 to effectuate this section."
 
20      SECTION 2.  Section 302A-401, Hawaii Revised Statutes, is
 
21 amended to read as follows:
 
22      "[[]§302A-401[]  Articulation agreement with the University
 
23 of Hawaii; enrollment.] Running start program.  [The department,

 1 in consultation with, and with the concurrence of, the University
 
 2 of Hawaii, shall establish rules] (a)  There is created in the
 
 3 department, the running start program to permit [qualified]
 
 4 eligible students to enroll in any [vocational or academic
 
 5 courses] qualified course offered by the University of Hawaii
 
 6 system[; provided that the courses apply to the department's
 
 7 graduation requirements or are otherwise permitted by the
 
 8 department's rules or policies].
 
 9      (b)  For the purposes of this section:
 
10      "Eligible student" means a high school student in the
 
11 eleventh or twelfth grade who:
 
12      (1)  Has passed a standardized test administered by the
 
13           college that demonstrates the student's ability to
 
14           succeed at the college level;

 9      (e)  This section shall not preclude the department and the
 
10 University of Hawaii from establishing programs by mutual
 
11 agreement that permit high school students to enroll in college
 
12 courses.
 
13      (f)  Every student enrolled in a college course pursuant to
 
14 this section shall remit appropriate tuition and fees to the
 
15 college for every college course.
 
16      (g)  The department shall adopt rules pursuant to chapter 91
 
17 to effectuate this section."
 
18      SECTION 3.  Statutory material to be repealed is bracketed.
 
19 New statutory material is underscored.
 
20      SECTION 4.  This Act shall take effect upon its approval.
