                   A  BILL  FOR  AN  ACT

RELATING TO TORT LIABILITY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 520, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§520-     Haiku stairs; limited liability of government
 
 5 landowners.  Haiku stairs and the associated access ways leading
 
 6 to Haiku stairs shall be covered under this chapter.  For the
 
 7 purposes of this chapter and notwithstanding ownership by any
 
 8 government entity, Haiku stairs means the approximately 3,922
 
 9 step stairway ascending the summit of the Ko`olau Mountain Range,
 
10 located in Haiku Valley, and includes the land on which trails
 
11 lead to the top of the stairs, the land over which the stairs
 
12 ascend, and access ways thereto."
 
13      SECTION 2.  Section 520-2, Hawaii Revised Statutes, is
 
14 amended by amending the definition of "land" to read as follows:
 
15      ""Land" means land, roads, water, water courses, private
 
16 ways and buildings, structures, and machinery or equipment when
 
17 attached to realty, other than lands owned by the government[.],
 
18 except as provided in section 520-   ."

 1      SECTION 3.  Statutory material to be repealed is bracketed.
 
 2 New statutory material is underscored.
 
 3      SECTION 4.  This Act shall take effect upon its approval.
