                   A  BILL  FOR  AN  ACT

RELATING TO THE UNIVERSITY OF HAWAII BOARD OF REGENTS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 304, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "§304-     Regents; evaluation of nominees by commission.
 
 5 (a)  There shall be a University of Hawaii regents nominees
 
 6 evaluation commission to be administratively attached to the
 
 7 senate of the legislature, which shall provide facilities and
 
 8 support to the commission.  The commission shall be composed of
 
 9 seven members as follows:
 
10      (1)  One member selected by the University of Hawaii Alumni
 
11           Association;
 
12      (2)  One member selected by the University of Hawaii faculty
 
13           senate;
 
14      (3)  One member selected by the board of regents;
 
15      (4)  One member selected by the research corporation of the
 
16           University of Hawaii;
 
17      (5)  One member selected by the board of education;
 
18      (6)  One member selected by the exclusive representative
 
19           representing the faculty of the University of Hawaii;

 1           and
 
 2      (7)  One member, who shall serve as chairperson, selected by
 
 3           the president of the senate.
 
 4 Each member shall serve at the pleasure of the selecting entity.
 
 5 Each member shall serve without pay, but shall be compensated for
 
 6 reasonable expenses under the rules of the senate.
 
 7      (b)  The commission shall meet from time to time upon the
 
 8 call of its chairperson or as otherwise provided by the
 
 9 commission to evaluate gubernatorial nominees to the board of
 
10 regents.  The commission's meetings shall be deemed executive
 
11 meetings under section 92-4 and shall be closed to the public.
 
12      (c)  Whenever a vacancy occurs on the board of regents and
 
13 before the senate may provide its advice and consent to the
 
14 governor's appointment, the governor shall submit the names of
 
15 all nominees for the vacancy to the commission.  The commission
 
16 shall have thirty days after receipt of the names to interview
 
17 each nominee, review the dossier of the nominee, and report to
 
18 the senate the following information:
 
19      (1)  The names, employment addresses, and employment of each
 
20           nominee;
 
21      (2)  Whether, in each member of the commission's opinion, a
 
22           nominee is unqualified, qualified, highly qualified, or
 
23           the most highly qualified;

 1      (3)  The salient qualifications of the nominees; and
 
 2      (4)  The skills and capabilities that the nominee would
 
 3           bring to the existing board of regents.
 
 4 The commission's report shall be deemed a disclosable government
 
 5 record under chapter 92F.
 
 6      (d)  The commission shall evaluate repeat nominees on the
 
 7 same basis as new nominees.  The commission shall provide the
 
 8 governor with its findings upon request by the governor."
 
 9      SECTION 2.  Section 26-11, Hawaii Revised Statutes, is
 
10 amended by amending subsection (a) to read as follows:
 
11      "(a)  The University of Hawaii shall be headed by an
 
12 executive board to be known as the board of regents.
 
13      [The board shall consist of twelve members.  No more than
 
14 six of the members shall be members of the same political party
 
15 and at least part of the membership of the board shall represent
 
16 geographic subdivisions of the State.  At least one member shall
 
17 be a University of Hawaii student at the time of the initial
 
18 appointment.  This member may be reappointed for one additional
 
19 term even though the member may no longer be a student at the
 
20 time of reappointment.]
 
21      The board shall have power, in accordance with the
 
22 Constitution of the State and with law, to formulate policy, and
 
23 to exercise control over the university through its executive

 1 officer, the president of the university.  The board shall have
 
 2 exclusive jurisdiction over the internal organization and
 
 3 management of the university."
 
 4      SECTION 3.  Section 304-3, Hawaii Revised Statutes, is
 
 5 amended to read as follows:
 
 6      "§304-3 Regents; appointment; tenure; qualifications;
 
 7 meetings.  (a)  The affairs of the university shall be under the
 
 8 general management and control of the board of regents consisting
 
 9 of twelve members [who shall be appointed and may be removed by
 
10 the governor].  No more than six of the members shall be of the
 
11 same political party and at least part of the membership of the
 
12 board shall represent geographic subdivisions of the State.
 
13 Members need not be residents of Hawaii.  At least one member
 
14 shall be a University of Hawaii student at the time of the
 
15 initial appointment.  The student member may be reappointed for
 
16 one additional term even though the member may no longer be a
 
17 student at the time of reappointment.
 
18      (b)  The governor shall nominate, and with the advice and
 
19 consent of the senate, shall appoint the members.  The governor
 
20 may remove members, with the consent of the senate.  Members
 
21 shall not serve past any statutory mandatory retirement age.  The
 
22 term of each member shall be for [four] ten years; provided that
 
23 the term of the student member shall be for two years.  A member

 1 may be reappointed once.  Except as otherwise provided by
 
 2 statute, state officers shall be eligible to appointment and
 
 3 membership.  Every member may serve beyond the expiration date of
 
 4 the member's term of appointment until the member's successor has
 
 5 been appointed and has qualified.
 
 6      (c)  The board shall at its first meeting after June 30,
 
 7 elect a chairperson and vice-chairperson, who shall serve until
 
 8 adjournment of its first meeting after June 30 of the next year
 
 9 or thereafter until their successors are appointed and have
 
10 qualified and whose election shall be immediately certified by
 
11 the board to the chief election officer. The board shall appoint
 
12 a secretary, who shall not be a member of the board.  The
 
13 president of the university shall act as executive officer of the
 
14 board.  The board shall meet not less often than ten times
 
15 annually, and may from time to time meet in each of the counties
 
16 of Hawaii, Maui, and Kauai.
 
17      (d)  The members of the board [shall serve without pay but]
 
18 shall be entitled to their traveling expenses within the State
 
19 when attending meetings of the board or when actually engaged in
 
20 business relating to the work of the board.  The members of the
 
21 board shall receive compensation in an amount not to exceed
 
22 $25,000 a year, to be set at the discretion of the board.  They
 
23 shall not be entitled to any other benefits."

 1      SECTION 4.  Statutory material to be repealed is bracketed.
 
 2 New statutory material is underscored.
 
 3      SECTION 5.  This Act shall take effect upon its approval.
