                   A  BILL  FOR  AN  ACT

MAKING AN APPROPRIATION FOR A NEW DRUG REHABILITATION FACILITY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that the State's
 
 2 increasing prison population will require the construction of yet
 
 3 another corrections facility.  After failed attempts to build a
 
 4 new prison locally, the governor has entertained ideas of
 
 5 financing a new facility on the mainland.  This mindset of
 
 6 building more to house more does little to address the true
 
 7 problems in our community that causes symptoms such as
 
 8 overcrowded prisons.
 
 9      It has become evident of late, that the root causes of our
 
10 burgeoning prison growth are overwhelmingly related to illegal
 
11 drugs.  Instead of mandatory incarceration, more and more states
 
12 have concentrated their efforts on the seemingly immutable
 
13 problems related to the sale and use of illegal drugs in our
 
14 society.  They are finding that the rehabilitation of drug users
 
15 while they are in prison has lasting effects on not only lowering
 
16 recidivism rates, but also assisting ex-convicts to build new
 
17 lives.
 
18      The purpose of this Act is to appropriate funds to build a
 
19 new drug rehabilitation facility to treat prison inmates instead

 1 of building new prisons.  The legislature believes that the
 
 2 diversion of a large number of potential prisoners to a drug
 
 3 rehabilitation facility will forestall the need for a new prison.
 
 4      SECTION 2.  There is appropriated out of the general
 
 5 revenues of the State of Hawaii the sum of $       , or so much
 
 6 thereof as may be necessary for fiscal year 2000-2001, to build a
 
 7 new drug rehabilitation facility to treat prison inmates.
 
 8      SECTION 3.  The sum appropriated shall be expended by the
 
 9 department of public safety.
 
10      SECTION 3.  This Act shall take effect on July 1, 2000.
