Limits the definition of "public employer", for the purpose of
negotiations only, to the governor in the case of correctional
workers (unit 10), and to the mayors of all the counties in the

                   A  BILL  FOR  AN  ACT

RELATING TO COLLECTIVE BARGAINING.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 89-6, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (b) to read as follows:
 
 3      "(b)  For the purpose of negotiations[,] only, the public
 
 4 employer of an appropriate bargaining unit shall mean [the]:
 
 5      (1)  The governor or the governor's designated
 
 6           representatives of not less than three together with
 
 7           not more than two members of the board of education in
 
 8           the case of units (5) and (6)[, the];
 
 9      (2)  The governor or the governor's designated
 
10           representatives of not less than three together with
 
11           not more than two members of the board of regents of
 
12           the University of Hawaii in the case of units (7) and
 
13           (8)[,];
 
14      (3)  The governor or the governor's designated
 
15           representatives of not less than three in the case of
 
16           unit 10, with respect to correctional workers only;
 
17      (4)  The mayors of all the counties or their designated
 
18           representatives in the case of unit (12); and [the]
 
19      (5)  The governor or the governor's designated

 1           representatives together with the mayors of all the
 
 2           counties or their designated representatives in the
 
 3           case of the remaining units.
 
 4 The designated employer representatives for units (5), (6), (7),
 
 5 [and] (8), 10 (with respect to correctional workers only), and 12
 
 6 shall each have one vote and in the case of the remaining units,
 
 7 the governor shall be entitled to four votes and the mayor of
 
 8 each county shall each have one vote, which may be assigned to
 
 9 their designated representatives.  Any decision to be reached by
 
10 the applicable employer group shall be on the basis of simple
 
11 majority."
 
12      SECTION 2.  Statutory material to be repealed is bracketed.
 
13 New statutory material is underscored.
 
14      SECTION 3.  This Act shall take effect upon its approval.
