Firearms


DESCRIPTION:
Makes it a class C felony to unlawfully sell, give, or a loan
firearm.  Creates presumption that registered owner of a firearm
unlawfully loaned firearm to another if person other than owner

                   A  BILL  FOR  AN  ACT

RELATING TO FIREARMS.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 134-2, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (h) to read as follows:
 
 3      "(h)  No person shall sell, give, lend, or deliver into the
 
 4 possession of another any firearm except in accordance with this
 
 5 chapter.  Any person who violates this subsection, in addition to
 
 6 the penalties imposed under section 134-17, shall be prohibited
 
 7 from owning or possessing any firearms for a period of ten years.
 
 8 The registered owner of any firearm shall be presumed to have
 
 9 violated this subsection if a person other than the owner commits
 
10 an offense with the registered owner's firearm, unless the
 
11 registered owner has reported the firearm stolen prior to the
 
12 commission of the offense." 
 
13      SECTION 2.  Section 134-17, Hawaii Revised Statutes, is
 
14 amended by amending subsection (c) to read as follows:
 
15      "(c)  Any person who violates section 134-2(h) shall be
 
16 guilty of a class C felony, and the firearm shall be confiscated
 
17 as contraband and disposed of pursuant to this chapter.  Any
 
18 person who violates section 134-2, 134-4, 134-10, 134-15, or

 1 134-16(a) shall be guilty of a misdemeanor.  Any person who
 
 2 violates section 134-3(b) shall be guilty of a petty misdemeanor
 
 3 and the firearm shall be confiscated as contraband and disposed
 
 4 of, if the firearm is not registered within five days of the
 
 5 person receiving notice of the violation."
 
 6      SECTION 3.  This Act does not affect rights and duties that
 
 7 matured, penalties that were incurred, and proceedings that were
 
 8 begun, before its effective date.
 
 9      SECTION 4.  New statutory material is underscored.
 
10      SECTION 5.  This Act shall take effect upon its approval.
