                   A  BILL  FOR  AN  ACT

RELATING TO FOREST RESERVES. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 183, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated as
 
 3 follows:
 
 4      "§183-    Native forests.  (a)  For purposes of taxation, a
 
 5 native forest shall be defined as:
 
 6      (1)  A parcel with a minimum area of ten acres; or 
 
 7      (2)  Adjoining parcels with total acreage of any amount;
 
 8 provided there is a forest cover of sixty per cent or more which
 
 9 shall be composed in the majority of indigenous plants as defined
 
10 by the department of land and natural resources, division of
 
11 forestry and wildlife.  Individual parcels within a group of
 
12 adjoining parcels do not need to meet the cover requirement but
 
13 the adjoining parcels together must meet the cover requirement.
 
14      (b)  For purposes of dedication, parcels or adjoining
 
15 parcels failing to meet the cover or indigenous plants
 
16 requirements may be recognized as native forests if the
 
17 application for recognition is accompanied by a management plan
 
18 specifying annual improvement schedules to either:
 
19      (1)  Replace non-indigenous species with plants recommended

 1           by the division of forestry and wildlife for the area;
 
 2           or
 
 3      (2)  Plant indigenous plants on bare land;
 
 4 provided the parcel or adjoining parcels meet statutory
 
 5 requirements within five years.  The management plan must be
 
 6 approved by the division of forestry and wildlife and progress on
 
 7 the plan shall be reviewed annually by the division of forestry
 
 8 and wildlife for the statutory period.  Certified arborists may
 
 9 be used for both recognition and reviewing purposes subject to
 
10 the division of forestry and wildlife's approval."
 
11      SECTION 2.  New statutory material is underscored.
 
12      SECTION 3.  This Act shall take effect upon its approval.
