                     A BILL FOR AN ACT

RELATING TO ELECTIONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 11-205.5, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§11-205.5  Campaign contributions by state contractors.
 
 4 (a)  Any person making [a] an expenditure for or contribution to
 
 5 any candidate, for an elective executive branch state or county
 
 6 office, committee, or political party, [and who has received, in
 
 7 any calendar year, $50,000 or more through] shall be prohibited
 
 8 from receiving contracts from the State, or county  [shall
 
 9 register and report that fact to the commission within thirty
 
10 days of the date of the contribution or within thirty days of the
 
11 date of the contract, whichever occurs later; provided that this
 
12 section shall not apply to a person who has received $50,000 or
 
13 more through a grant, subsidy, or purchase of service agreement
 
14 under chapter 42F or 103F.] as described under sections 103D-303
 
15 and 103D-304.  This prohibition shall apply from within one year
 
16 of notice of the availability of the contract, or the date of the
 
17 contract, whichever is earlier, through one year after completion
 
18 of all terms of the contract.
 
19      (b)  [The commission shall prescribe forms and procedures
 
20 for the reporting required in subsection (a) which, at a minimum,

 1 shall require the following information:
 
 2      (1)  The name and address of the person making the
 
 3           contribution;
 
 4      (2)  The name of the candidate, committee, or political
 
 5           party receiving the contribution;
 
 6      (3)  The amount of money received from the State or county,
 
 7           the dates, and information identifying each contract
 
 8           and describing the service performed or goods provided;
 
 9           and
 
10      (4)  If an entity is making the contribution, the names and
 
11           business addresses of the principals, including
 
12           officers and directors.]
 
13      Contracts shall include subcontracts and any similar
 
14 agreement with the State or county.
 
15      (c)  [The commission shall maintain a list of such reports
 
16 for public inspection both at the commission's office and through
 
17 the state FYI electronic bulletin board.] Contributions and
 
18 expenditures shall be prohibited from principals directly
 
19 associated with contracts, including immediate family members,
 
20 during the same time period provided under subsection (a)."
 
21      SECTION 2.  Statutory material to be repealed is bracketed.
 
22 New statutory material is repealed.
