                   A  BILL  FOR  AN  ACT

RELATING TO OPTOMETRY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 459-7.4, Hawaii Revised Statutes, is
 
 2 amended as follows:
 
 3      1.   By amending subsection (a) to read:
 
 4      "(a)  The use and prescription of topical therapeutic
 
 5 pharmaceutical agents as [established] recommended by the joint
 
 6 formulary advisory committee and adopted by the board for the
 
 7 treatment and management of conditions of the anterior segment of
 
 8 the human eye, eyelids, and lacrimal system and the non-invasive
 
 9 surface removal of superficial foreign bodies from the anterior
 
10 segment of the human eye and eyelids is authorized only for an
 
11 optometrist licensed under this chapter who meets the
 
12 requirements of a therapeutically certified optometrist as
 
13 authorized in this section.  The therapeutically certified
 
14 optometrist shall not prescribe, dispense, or administer oral
 
15 pharmaceutical agents except those available without
 
16 prescription.  Treatment of glaucoma and performing any invasive
 
17 surgery shall not be allowed.  Therapeutic pharmaceutical agents
 
18 shall not include any of the controlled substances enumerated in
 
19 sections 329-14, 329-16, 329-18, 329-20, and 329-22."

 1      2.   By amending subsection (c) to read:
 
 2      "(c)  The department of commerce and consumer affairs shall
 
 3 establish a joint formulary advisory committee composed of:
 
 4      (1)  Two persons licensed as optometrists;
 
 5      (2)  Two persons licensed as pharmacists; and
 
 6      (3)  Two persons licensed in medicine by the board of
 
 7           medical examiners and board certified in ophthalmology.
 
 8 The joint formulary advisory committee shall recommend the
 
 9 applicable formulary for persons certified under this section.
 
10 The board of optometry [shall] may adopt the formulary as
 
11 [established] recommended by the joint formulary advisory
 
12 committee in its rules."
 
13      SECTION 2.  Statutory material to be repealed is bracketed.
 
14 New statutory material is underscored.
 
15      SECTION 3.  This Act shall take effect ______________.
