                   A  BILL  FOR  AN  ACT

RELATING TO THE OFFICE OF HAWAIIAN AFFAIRS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1. Section 13D-1, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§13D-1 Board of trustees; number; composition.  The board
 
 4 of trustees shall be composed of nine [members elected] members:
 
 5 five members shall be elected based on residency and four members
 
 6 shall be elected at-large by qualified voters in the State who
 
 7 are Hawaiian.  Of the nine members to be elected [one shall
 
 8 reside on the island of Hawaii; one shall reside on the island of
 
 9 Maui; and one shall reside on the island of Molokai; one shall
 
10 reside on the island of Kauai; and one shall reside on the island
 
11 of Oahu.]:
 
12      (1)  The four at-large members shall reside in the State and
 
13           shall be elected by qualified voters residing in the
 
14           State;
 
15      (2)  One member shall reside in the county of Hawaii and
 
16           shall be elected by qualified voters residing in the
 
17           county of Hawaii;
 
18      (3)  One member shall reside in the county of Maui and shall
 
19           be elected by qualified voters residing in the county
 
20           of Maui, encompassing the island of Lanai and the
 
21           island of Kahoolawe;

 1      (4)  One member shall reside on the island of Molokai and
 
 2           shall be elected by qualified voters residing on the
 
 3           island of Molokai; and
 
 4      (5)  One member shall reside in the county of Kauai and
 
 5           shall be elected by qualified voters residing in the
 
 6           county of Kauai.
 
 7      (6)  One member shall reside in the city and county of
 
 8           Honolulu and shall be elected by qualified voters
 
 9           residing in the city and county of Honolulu."
 
10      SECTION 2.  Section 13D-4 Hawaii Revised Statutes, is
 
11 amended to read as follows:
 
12      "§13D-4 Election of board members.  Members of the board of
 
13 trustees shall be elected at a special election held in
 
14 conjunction with the general election in every even-numbered
 
15 year.  Except as otherwise provided by this chapter, members
 
16 shall be nominated and elected in the manner prescribed by this
 
17 title.
 
18      [Nomination papers.]  The chief election officer shall
 
19 prepare the nomination papers in such a manner that a candidate
 
20 desiring to file for election to the board shall be able to
 
21 specify whether the candidate is seeking a seat requiring
 
22 residency on a particular island or a seat without such residency
 
23 requirement.
 
24      [Ballot.]  The board of trustees ballot shall be prepared in
 
25 such a manner that every voter qualified and registered under
 
26 section 13D-3 shall be afforded the opportunity to vote for [each

 1 and] every candidate seeking election [to the board.] at-large
 
 2 and every candidate seeking election in the county in which that
 
 3 particular voter resides pursuant to section 13D-1.  The ballot
 
 4 shall contain the names of all board candidates arranged
 
 5 alphabetically; provided that the names of candidates seeking
 
 6 seats requiring residency on a particular island shall also be
 
 7 grouped by island of residency.  Each eligible voter shall be
 
 8 entitled to receive the board of trustees ballot [and to vote for
 
 9 the number of seats available]."
 
10      SECTION 3.  Statutory material to be repealed is bracketed.
 
11 New statutory material is underscored.
 
12      SECTION 4.  This Act shall take effect upon its approval.
