DESCRIPTION:
Prohibits a person making an expenditure for (not only a
contribution to) any candidate committee or political party from
receiving a contract from the state or county for one year from
the availability of the contract, including subcontracts.

                   A  BILL  FOR  AN  ACT
RELATING TO ELECTIONS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 11-205.5, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§11-205.5  Campaign contributions by state contractors.
 
 4 (a)  Any person making [a] an expenditure for or contribution to
 
 5 any candidate, committee, or political party, [and who has
 
 6 received, in any calendar year, $50,000 or more through] shall be
 
 7 prohibited from receiving contracts from the State, or county
 
 8 [shall register and report that fact to the commission within
 
 9 thirty days of the date of the contribution or within thirty days
 
10 of the date of the contract, whichever occurs later; provided
 
11 that this section shall not apply to a person who has received
 
12 $50,000 or more through a grant, subsidy, or purchase of service
 
13 agreement under chapter 42F or 103F.
 
14      (b)  The commission shall prescribe forms and procedures for
 
15 the reporting required in subsection (a) which, at a minimum,
 
16 shall require the following information:
 
17      (1)  The name and address of the person making the
 
18           contribution;
 
19      (2)  The name of the candidate, committee, or political
 
20           party receiving the contribution;

 1      (3)  The amount of money received from the State or county,
 
 2           the dates, and information identifying each contract
 
 3           and describing the service performed or goods provided;
 
 4           and
 
 5      (4)  If an entity is making the contribution, the names and
 
 6           business addresses of the principals, including
 
 7           officers and directors.], as described under sections
 
 8           103D-303 and 103D-34, Hawaii Revised Statutes.  This
 
 9           prohibition shall apply from within one year of notice
 
10           of the availability of the contract, or the date of the
 
11           contract, whichever is earlier.  No person who receives
 
12           a contract shall make expenditures or contributions to
 
13           a candidate committee or party within one year after
 
14           completion of all terms of the contract.
 
15      (b)  For purposes of this section a person shall include
 
16 primary contracts and subcontracts or any other agreement for
 
17 services provided under subsection (a) with the State or county.
 
18      (c)  [The commission shall maintain a list of such reports
 
19 for public inspection both at the commission's office and through
 
20 the state FYI electronic bulletin board.] Contributions and
 
21 expenditures shall be prohibited from principals directly
 
22 associated with contracts and subcontracts, including immediate
 
23 family members, during the same time period provided under

 1 subsection (a)."
 
 2      SECTION 2.  Statutory material to be repealed is bracketed.
 
 3 New statutory material is underscored.
 
 4      SECTION 3.  This Act shall take effect on January 1, 2001.
