                   A  BILL  FOR  AN  ACT

RELATING TO THE MOTOR VEHICLE RENTAL INDUSTRY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 437D-3, Hawaii Revised Statutes, is
 
 2 amended by adding a new definition to be appropriately inserted
 
 3 and to read as follows:
 
 4      ""Damage to rental motor vehicle" or "damage to vehicle"
 
 5 means:
 
 6      (1)  The actual cost of parts, labor, and materials, or
 
 7           appraised estimate to repair the damage, or diminution
 
 8           in value if the vehicle is not repaired, or the book
 
 9           value of the vehicle if it is declared a total loss;
 
10      (2)  The appraisal fees paid by the lessor;
 
11      (3)  The actual towing charges;
 
12      (4)  The loss of vehicle until it is repaired or replaced;
 
13           and
 
14      (5)  The administrative fee that directly reflects costs
 
15           incurred and substantiated by the lessor that are
 
16           directly associated with handling and collecting
 
17           damages to the vehicle from the lessee."
 
18      SECTION 2.  New statutory material is underscored.
