                   A  BILL  FOR  AN  ACT

RELATING TO HIGHWAYS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 264-64, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§264-64  Design of controlled-access facility and
 
 4 regulation, restriction, or prohibition of access; penalty.  The
 
 5 director of transportation may so design any controlled-access
 
 6 facility and so regulate, restrict, or prohibit access as to best
 
 7 serve the traffic for which such facility is intended.  In this
 
 8 connection, the director may divide and separate any controlled-
 
 9 access facility into separate roadways by the construction of
 
10 raised curbing, central dividing sections, or other physical
 
11 separations, or by designating the separate roadways by signs,
 
12 markers, stripes, and the proper lane for the traffic by
 
13 appropriate signs, markers, stripes, and other devices.
 
14      No person shall have any right of ingress or egress to,
 
15 from, or across controlled-access facilities to or from abutting
 
16 lands, except at the designated points at which access may be
 
17 permitted, upon such terms and conditions as may be specified by
 
18 the director[.]; provided that the director shall permit use by a
 
19 person for emergency medical purposes subsequently documented on

 1 the same day of use by a physician or surgeon licensed under
 
 2 chapter 453 or 460.  Any person who violates this section shall
 
 3 be fined not more than $250 or imprisoned not more than three
 
 4 months, or both."
 
 5      SECTION 2.  Statutory material to be repealed is bracketed.
 
 6 New statutory material is underscored.
 
 7      SECTION 3.  This Act shall take effect upon its approval.
