REPORT TITLE:
Educational accountability


DESCRIPTION:
Mandates that DOE implement the educational accountability system
for Hawaii's public schools that focuses on student learning of
the statewide standards and includes student accountability;
school or collective professional accountability of rewards,
assistance, and sanctions; individual professional
accountability; and public accounting for other significant

                   A  BILL  FOR  AN  ACT

RELATING TO EDUCATIONAL ACCOUNTABILITY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 302A-1004, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "§302A-1004  Educational [assessment and] accountability[;]
 
 4 system; annual reports.(a)  The department shall [establish]
 
 5 implement a comprehensive system of educational accountability to
 
 6 motivate and support the improved performance of students and the
 
 7 education system.  This accountability system shall:
 
 8      (1)  Include:
 
 9           (A)  Student accountability;
 
10           (B)  School or collective professional accountability;
 
11           (C)  Individual professional accountability for
 
12                teachers and administrators; and
 
13           (D)  Public accounting for other significant partners
 
14                to the education process;
 
15     [(1)] (2)  Link authority and adequate resources to
 
16           responsibility;
 
17     [(2)] (3)  Define clear roles for all parties and lines of
 
18           responsibility and mutual obligation;
 
19     [(3)] (4)  Involve fair and adequate assessment against
 
20           agreed upon goals;

 1     [(4)  Invoke appropriate actions (assistance, rewards, or
 
 2           sanctions) for observed performance;] 
 
 3      (5)  Invoke a full and balanced set of appropriate
 
 4           consequences for observed performance, including:
 
 5           (A)  Rewards and recognition for schools that meet or
 
 6                exceed their goals;
 
 7           (B)  Assistance to those that fall short; and
 
 8           (C)  Sanctions for those that, given adequate
 
 9                assistance and ample time, continue to fail to
 
10                meet their goals;
 
11     [(5)] (6)  Involve a statewide student assessment program
 
12           that [is explicitly aligned with the Hawaii] provides
 
13           annual data on student, school, and system performance
 
14           at selected benchmark grade levels in terms of student
 
15           performance relative to statewide content and
 
16           performance standards and embodies high and rigorous
 
17           expectations for the attainment of all students; [and
 
18      (6)  Involve a comprehensive school profile or report card
 
19           for each school, which shall include, but not be
 
20           limited to, student performance measures, school
 
21           attendance, drop-out rates, and parental involvement.
 
22           These reports shall be made available annually to the
 
23           board, the governor, the legislature, the parents, and
 
24           the general public.

 1      Beginning with the 2001-2002 school year, the department
 
 2 shall submit to the legislature, the governor, and the board of
 
 3 education at least twenty days prior to the convening of each
 
 4 regular legislative session a report of the specifics of the
 
 5 design of the comprehensive accountability system, as well as the
 
 6 fiscal requirements and legislative actions necessary to create
 
 7 the accountability system.]
 
 8      (7)  Require that teachers and administrators engage in
 
 9           continuous professional growth and development to
 
10           ensure their currency with respect to disciplinary
 
11           content, leadership skill, knowledge, or pedagogical
 
12           skill, as appropriate to their position.  This
 
13           requirement may be established by the department in
 
14           terms of credit hours earned or their equivalent in
 
15           professional development activities certified by the
 
16           department as being appropriate in focus and rigor; and
 
17      (8)  Establish an explicit link between professional
 
18           evaluation results and individual accountability for
 
19           professional development of the knowledge, skill, and
 
20           professional behavior necessary to the position, by
 
21           requiring that results of the professional evaluation
 
22           be used by the department to prescribe appropriate
 
23           consequences.  Appropriate consequences include a full

 1           and balanced range of actions for observed performance
 
 2           such as recognition or reward, assistance, and
 
 3           sanction.
 
 4      (b)  The department shall submit to the legislature and to
 
 5 the governor, at least twenty days prior to the convening of each
 
 6 regular legislative session, an educational status report that
 
 7 includes but is not limited to the following:
 
 8      (1)  Results of school-by-school assessments of educational
 
 9           outcomes[, including reference to such student
 
10           performance standards and school-by-school assessment
 
11           models as may be developed by the commission on
 
12           performance standards and adopted by the board.  This
 
13           paragraph is repealed on June 30, 2001];
 
14      (2)  Summaries of [school improvement plans;] each school's
 
15           standards implementation design;
 
16      (3)  Summary descriptions of the demographic makeup of the
 
17           schools, with indications of the range of these
 
18           conditions among schools within Hawaii;
 
19      (4)  Comparisons of conditions affecting Hawaii's schools
 
20           with the conditions of schools in other states; and
 
21      (5)  Other such assessments as may be deemed appropriate by

 1      (c)  The department shall provide electronic access to
 
 2 computer-based financial management, student information, and
 
 3 other information systems to the legislature and the auditor.
 
 4 The department shall submit to the legislature and to the
 
 5 governor, at least twenty days prior to the convening of each
 
 6 legislative session, a school-by-school expenditure report that
 
 7 includes but is not limited to the following:
 
 8      (1)  The financial analysis of expenditures by the
 
 9           department with respect to the following areas:
 
10           (A)  Instruction, including face-to-face teaching, and
 
11                classroom materials;
 
12           (B)  Instructional support, including pupil, teacher,
 
13                and program support;
 
14           (C)  Operations, including non-instructional pupil
 
15                services, facilities, and business services;
 
16           (D)  Other commitments, including contingencies,
 
17                capital improvement projects, out-of-district
 
18                obligations, and legal obligations; and
 
19           (E)  Leadership, including school management, program
 
20                and operations management, and district
 
21                management;

 1      (2)  The measures of accuracy, efficiency, and productivity
 
 2           of the department, districts, and schools in delivering
 
 3           resources to the classroom and the student.
 
 4      (d)  The implementation of this section shall not be subject
 
 5 to negotiation under chapter 89."
 
 6      SECTION 2.  Act 74, Session Laws of Hawaii 1999, is amended
 
 7 by amending section 3 to read as follows:
 
 8      "SECTION 3.  The department of education shall submit a
 
 9 report on [the findings and recommendations of the design of the
 
10 comprehensive accountability system referred to in section 2 of
 
11 this Act, to the legislature, and to the governor, at least
 
12 twenty days prior to the convening of the regular legislative
 
13 session of 2000.  This report shall include, but not be limited
 
14 to, the essential elements of the design, a timeline for its
 
15 implementation, the legislative actions necessary to enable
 
16 implementation, as well as a fiscal note describing resources
 
17 necessary to execute the designs.  The department of education
 
18 shall submit a report on] the status of the implementation of the
 
19 [comprehensive] educational accountability system to the
 
20 legislature, and to the governor, at least twenty days prior to
 
21 the convening of the regular legislative session of 2001."
 
22      SECTION 3.  Statutory material to be repealed is bracketed.
 
23 New statutory material is underscored.
 
24      SECTION 4.  This Act shall take effect upon its approval.
