                   A  BILL  FOR  AN  ACT

RELATING TO THE HAWAIIAN LANGUAGE COLLEGE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that the Hawaiian language
 
 2 college known as Ka Haka `Ula O Ke`elikolani was established
 
 3 during the 1997 regular session of the legislature at the
 
 4 University of Hawai`i at Hilo to serve as a focal point for the
 
 5 revitalization of the Hawaiian language.  As can be expected,
 
 6 questions were raised about this new college during its
 
 7 beginnings.  However, since then the commitment of the faculty
 
 8 and the progress made by the college have demonstrated its
 
 9 viability and relevance to the community.  Since its
 
10 establishment, the college has successfully carried out the
 
11 purposes for which it was established including initiation of a
 
12 graduate program in the Hawaiian language, a teacher education
 
13 certificate in the Hawaiian language, and a laboratory school
 
14 program in the Hawaiian language.  These programs are firsts for
 
15 a Native American language, making important contributions to the
 
16 State and extensive use of technology.
 
17      One of the problems faced by the college is that the college
 
18 is required by statute to contract with the research corporation
 
19 of the University of Hawaii for research and training activities

 1 that cannot be provided by state agencies.  Since the Hawaiian
 
 2 language college conducts its business in the Hawaiian language,
 
 3 it is difficult to do business with the research corporation of
 
 4 the University of Hawaii, which is set up to operate in the
 
 5 English language.  It should be noted that the Hawaiian language
 
 6 is one of the two official languages of the State (the other
 
 7 being English).  An exception should be made to allow the college
 
 8 to contract directly with providers.  Allowing the Hawaiian
 
 9 language college to contract directly with providers is
 
10 especially important in its relationship with the private
 
11 Hawaiian language organization, the `Aha Punana Leo, Inc. with
 
12 which the college is mandated to work by Act 315 establishing the
 
13 college.  The `Aha Punana Leo, Inc. jointly operates with the
 
14 college its laboratory school program and carries out several
 
15 other activities in consortium with the college.
 
16      SECTION 2.  Section 304-10.5, Hawaii Revised Statutes, is
 
17 amended by amending subsection (a) to read as follows:
 
18      "(a)  Notwithstanding any law to the contrary, when the
 
19 university determines that neither the university nor another
 
20 state agency can more effectively or efficiently accomplish the
 
21 purposes of the sponsored research and training activities, the
 
22 university shall contract with the [Research Corporation]
 
23 research corporation of the University of Hawaii established

 1 under chapter 307 to provide management and other services as
 
 2 described in subsection (b) to support the university's research
 
 3 and training activities[.]; provided that, when conducting
 
 4 business in the Hawaiian language, the college of Hawaiian
 
 5 language of the University of Hawaii at Hilo may contract
 
 6 directly with providers, including the 'Aha Punana Leo, Inc.,
 
 7 with the same authority and privileges as the research
 
 8 corporation has.  Contracts by the university with the research
 
 9 corporation pursuant to this section shall be limited to
 
10 sponsored research and training projects, except that university
 
11 projects supported by state-appropriated funds may also be
 
12 contracted to the research corporation pursuant to rules adopted
 
13 by the university."
 
14      SECTION 3.  Statutory material to be repealed is bracketed.
 
15 New statutory material is underscored.
 
16      SECTION 4.  This Act shall take effect upon its approval.
